A BRUTAL ASSAULT. John Charged With Intent to Kill. A great big, brawny slugger sat in a chair this morning at the Mayor's court nervously twisting his fingers and picking at threads in his clothes. The man was a six with shoulders as broad as double doors and. muscles like a Hercules.

Fle goes by the name of Benner-John Benner, and he is alated for assault with intent to kill. The victim of his murderous impulse is boy named Edward Weis, the twenty year old son of Adam Weis, an old shoemaker at No. 2 Front stroct. Yesterday afternoon. about 3 o'clock, young Weis and two companions were sitting down by the old Eel river shops, talking, when Benner appreached them.

Without saying a word he went straight for Weis and knocked him from. his sent, then stamped and kicked him frightfully in the sides and abdomen until exhausted by his efforts Weis' companions could do nothing with the muscular villian and when he left they picked up their friend and carried him home apparently dead. He remained in this condition for some time but finally returned to consciousness, only to suffer the most intonso pain. He is able to speak barely above a whisper and is thought to be fatally hurt internally. The warrant upon which officer Manders! arrested Benner this morning was for assault and battery on which charge he' gave $500 bail with Dave Humphrey as security.

Immediately afterward, however, the authorities learned that Benner's victim was in a gerous condition and ro-arrested him upon the more serious charge of assault with iptent to kill: On this churge $2,000 bond WaS required, which Bonner failed to give. Benner clairs that' Saturday night young Weis and two companions guyed him while walking with a lady friend on North street and when he answered they responded with a voiley of stones. He does not deny that he commit-! ted the assault yesterday but seems to think his revenge is justifiablea view which the law will hardly sustain even should he prove his story to be correct. Dr. Busjabn, who was summoned to give the boy 'medical attention, found bim yesterday in a stupor end able to give but little heed to.

Sequel of a Sad Story. Miss Grace Forney, of Wabash, concerning whose elopement with Walter: Koenig, formerly of Thomas' orchestra, the papers have had much to say in the past. few weeks, was in the city Saturday evening on her way home. Miss Forney wa's deceived by a mock marriage at La Fountaine and lived with the false musician until day last when he duserted her at Russiaville.

The young woman was in the care of Marshal Ellis, of Wabash, and returned home thoroughly ponitent. Koenig, in his flight, took with him a horse and buggy belonging to D. 0. Cranston, of Wabash, and will be given the fallest extent of the law when caught. He is a villian of the most pronounced typu and doserves all the punishment any court may see fit to administer on him.

A Forger Escapes. Tillman Ratcliff, Young America, last Friday forged the names of three prominent residente. of Itussiaville to a note for $1,000 and tried to obtain money on it from. Frank Crockett. of Tipton.

He was discovered however: before obtaining the money and turned over to' the officers who put him in a carriage and started out for Kokomo. Near West Middleton the prisoner wrested himself from the officers and made good his escape. He fled the county immediately and has not been heard of since. Woll and wife have returned from a fow day's visit ai Maxinkuckee. Mr. Adolph Kann, of Mishawaka, and Mrs. Theresa Bierlein, of Lima, are the guests of Mr. Adolph Lienemann, of this city.

P. Fox, retiring treasurer of Salesmen's Union, No. 6, to-day. handed to his successor, Ed: Bishop, $145.71, funds belonging. to the organization.

About forty trainmen, of this city, friends of the late Elmer H. Blanchard, attended his funeral, held yesterday afternoon at Hebron land returned last night at 12:40. Will.

Burgman made a trip to Ft. Wayne yesterday and return on his wheel. On his way back he took a header and received several bruises but expects to be in trim for the races Saturday. Any one being afflicted with rupture will be glad to learn that Dr. Ballard has invented an aparatus with which he can cure rupture 'of whatever age or kind.

Office corner 4th and Market streets. Logansport, Ind. Joseph Sellers, of enst Spear street, is reported seriously ill from the effects of the heat yesterday. Mr. Sellers suffered a Sunstroke about two years ago and the intense heat brought on EL repeti- tion.

Fourth of July Rates. For the 4th of July the Vandalin Line will sell tickets at one fare for the round trip betwe. all points within a radius of two hundred miles. Tickets on sale July 3d and 4th, and good to return, including July 6th. 1891.

Excursion tickets will also be sold to points on the Ciocinnati, Hamilton Dayton railroad, Cleveland, Cincinnati, Chicago St. Louis railway, Evansville Terre Haute railroad, Louisville, New Albany Chicago railway, within two hundred miles of initial point. And to all points located on the Illinois Central railroad, regardlees of distance, at one and one-third fare for the round trip. For further information, apply to ticket agents, J. M.

For Keeping Open Sunday. Al Deweese, bartender for Martin Bligh, was last nigbt. arrested by Officers Morrissey and Cronin for the illegal sale of liquors. About midnight the two officers got in at a rear entrance and discovered two men drinking beer. In order to obtain a clear case, they took the glasses and tasted of the beverage that they might be able to swear its character when the case should be tried.

They claim that the officers effected an entrance by forcing open the screen door and there was talk day of a case being Bled against them 011 this ground, or of having them brought before the police board. A Fortunate Discovery. A blaze was discovered this morning in the Snider block, to 414 Market street, which would have proven very disastrous had it not been located before gaining headway. The flames started in the rooms 'over the queensware store occupied by W. HI.

Atkinson, and were discovered by C. H. Stevens, the photographer, by means of smoke in the hall way. The carpet had been badly damaged and one chair burnt up before the fire was extinguished. How the fire Dated is a mystery and is' thought to be the work of un incendiary, as Mr.

Atkinson went away this morning about 4 o'clock leaving no trace of fire whatever abont his room. Death of Chas. Elpers. Charles Elpers died yesterday at 11:30 at his home No. 715 Chippewa street, after a twelve dava' attack of typhoid fever.

The deceased was born and reared in this city, where he was well known by all and had a host of warm, friends. He was a tinner by trade. a skiliful workman and a faithful! employe. Death took him away in the very prime of life, he being but 40 years of age, aud leaves in bercavenront a family consisting of a wife and five small children. The funeral services will be conducted at St.

Bridget's church to-morrow at 9 o'clock by Rev. Father Kroeger. Internment in Mt. St. Vincent cem- etery.
