ASSOCIATED FFX5S NIGHT REPORT.l SAN FRANCISCO, Dec 4- On telegraphic orders from the Department of Commerce and Labor. Moyses do Amaral. said to be. the son of a Portuguese nobleman and alleged to have been a fugitive from Justice on the Azores Island, was set at liberty today by Immigration Commissioner Hart H. North, who had been holding Amaral for deportation.

Amaral was said to have killed a man in the Azores, after which he fled to the United States. Despite his 8 b-sense, the Azores authorities tried him for murder and convicted him. Extradition proceedings were begun, but after Amaral had been in custody sixty days and the transcript of his trial did not arrive, he was free under ha-bas corpus proceedings, but immediately rearrested on the order of Commissioner North, acting for the Department of Commerce and Labor. The Secretary of the department found that as Amaral had not been present at hi triI for murder he could not have been convicted legally, and therefore was not a fugitive. JAILED FOR CONTEMPT.

Ramon Real, a witness in the Juvenile Court, became abusive when questioned by Deputy District Attorney Max Grimm today, and Judge Smith sentenced him to forty-eight hours in Jaii for, contempt.

Mrs. N. Soto had been brought before the Juvenile Court on contempt proceedings, for falling to pay for the care of her eight-year-old son, who had been placed in an orphanage in San Francisco by order of the Juvenile Court. When Real was called to testify became very angry, and replied in an insulting manner to questions put to him. First he was cautioned, and finally Judge Smith told him to sit while the case was being completed.

With the testimony finished, the Judge ordered Real to stand up. After delivering a short lecture to' him. the Judge ordered Real locked up for forty-eight hours, much to his surprise. Mrs. Soto was given an extension of time to pay the amount for the keep of her child.

Dec. 4. Evidence of brutal assault, robbery and murder was given today with the discovery of the partly clothed body of a woman on a roadway near the little vlllags of Munson, L. I. The victim was Identified as Mrs.

Julia A. Wallace, wife of a prosperous farmer of Munson. There were indications that after a struggle she had been thrown into a pond, but managed to drag herself from the water and crawl to the roadway. Mrs. Wallace was in the habit of carrying a considerable sutn of money.

Lyppes approached the men to see if she could recognize them, but was seized and bound hand and foot, after which she was carried into an adjoining room, where she would be out of the way. A woman who was about to enter the store was grabbed by a fourth man, serving as a lookout and shoved inside, where she was given treatment similar to that accorded Mrs. Lyppes. Another- customer, a young man, was aiso bound hand and foot. After completing this part of their work, the Highwaymen searched their victims, securing $400 in cash and a gold watch.

Because the members of a State Board of Health are not experts on eggs, it was necessary for them to postpone action today in the cases of, six egg dealers of Los Angeles, who had been cited for alleged violations of the pure-food' laws. There- Is a. clause in the new law which provides that eggs put up In cold storage shall not be too fresh, nor too aged. Just where is the dividing line was the question raised by the attorneys for the dealers yesterday, and was the question that "stumped" the board.

The doctors were so much In doubt that they laid the cases and the eggs over until the hext meeting. Meantime experts wll be called in to enlighten them and depositions will be taken also from men in a position to know something about storage eggs. It was claimed by an Inspector of health board that these Log Angeles dealers were selling cold-storage eggs as fresh eggs and that the hen fruit was not in an inviting condition. The dealers claimed, on the other hand, that the eggs in question were loaded into refrigerator cars almost as soon as they were laid in the East, and that they were as good and valuable as first-class ranch eggs of California. This difference of opinion will be not by the State Board of Health, but for them.

charges that firm with shipping to Dillon, a product marked pure extract of lemon, which contained less than 1 per cent, of lemon oil and which was artificially colored. The International Wine and Brandy Company was indicted for shipping to Tonopah, Nov, bottles of liquor labeled "Bert's Apricot Brandy Cordial-Guaranteed Under the Pure Food Act," but which, according to the counts in the complaint, did not contain any apricot Juice. J. Achino was indicted for using the malls to conduct what the postal authorities maintain was a fake employment agency. According to the counts ifl the indictment, Achino established tnese agencies in various cities in this State, and by offering to secure Jobs Tor people in the East, took money from them without making any return.

Miss Lydla Rodney, seventy-three years old, was kept in duress in her home at 128 North Twenty-second street for about three weeks with, insufficient food and subjected to threats of violence by her brother, Henry F. Rodney, according to her charge, made before Judge Wetster in the County Court today.

After a detailed investigation, the authorities tonight were unable to determine whether Miss Goldle Ingberg, the twenty-year-old girl, who met a mysterious death at her home early today, Mas murdered or committed suicide. The police generally accept tho theory that the girl killed" herself, but physicians who examined the body, are divided in opinion.

"They got my diamonds and then gave me poison." gasped Jhe girl to her mother, who found her dying on the front porch of the house. Her lips were burned with acid. The diamond ear-rings were gone. Every circumstance pointed to murder. But the police advance another theory.

The girl may have quarreled with the person who gave her the diamonds and returned them. Then, In a fit of remorse, she may have killed herself, and In order to protect her family, told the murder story. If the girl was murdered, her slayer entered the front bedroom, dragged her to the porch, and after taking her diamonds, poured acid down her throat. Miss Ingberg's ear-rings had been torn from her ears. She lived but a short time after being found by her mother.

Today's mystery, following closely upon the killing of William Bork, his young wife and ch'ld a week ago, has renewed the excitement in this vicinity. Miss Ingberg occupied a. front bedroom somewhat Isolated from the other portion of the house. Mrs. Ingberg was awakened by her daughter calling, "mother, mother." Mrs.

Ingberi hurried to the daughter's bedroom, but found the door from that room leading to the porch open. Further search revealed the girl lying on the porch and barely able to say: "They have my diamonds; gave me poison." Miss Ingberg with difficulty told of two men having attacked her while she lay abed. She said the men had poured carbolic acid into her mouth, then while" one of the men placed his hand over her lips, they dragged her onto the porch, and pulled the diamond ear-rings from their place. Miss Ingberg soon lost consciousness and died without describing her assailants. CASHED BOGUS CHECKS.

TOUCHED FRATERNITY MEN, (BY DIRECT WIRE TO THE TIMES. -SAN Dec. Dispatch. Accused of making hi membership in a Greek letter college fraternity a lever to induce his brother members to cash checks for him, which afterward proved bogus, J. k.

Davis arretted today on complaint of Colbert Coldwell, a member of the real estate firm of Tucker, Lynch Cold-well. Coldwell alleges that he cashed for Davis a check for MQ0, drawn on a bank of Philadelphia, which was returned by the bank as worthless. As-cording to Coldwell, Davis came to his office three weeks ago and showed Coldwell that they were members of the same fraternity. On the of this, Davis is alleged to have Induced Coldwell to cash the check. Davis then left for Los Angeles.

When the check was returned, Coldwell related the matter to Attorney Dunlap, and steps were about to be taken for the apprehension of Davis. This afternoon Davis, returning from Los Angeles, visited Dudlap's office. Dunlap is also a member of the same fraternity, and Davis htm and wanted Dunlap to casft a check The latter excused himself and telephoned for Coldwell. When the latter arrived he immediately recognized Davis, and Patrolman Patrick Sullivan was summoned, who placed Davisjun-der arrest. The prisoner refused to talk.

He had evidently operated extensively in the far West and on the Pacific Coast. Upon arriving In Mobile several weeks ago Richter opened accounts in two Mobile banks, one under the name of Richter, the other in the name of Muller. A fourth child, 2 years old, also waa attacked and is dying. The traaredy first was discovered when Jimmie Lubeca, aged 6 years, ran bleeding from the house.

Holcomb, a prominent resident of this city for many years, was instantly killed last night in a runaway accident. Mr. Holcomb, accompanied by his son, A. S. Holoomb, was driving into town from their home at; the outskirts of the city, when the horse they were driving became frightened at a pile of rubbish and was soon beyond oontrol of the driver.

-Mr. Holcomb, by a supreme effort, checked 'the horse momentarily and told his son to Jump from the rig, which the boy did. The horse then dashed to the side of street and the buggy struck a tree, buggy and horse parting company. The jar threw Mr. Holcomb with great force to the ground and when his son, who was uninjured, reached his side, he was horrified' to find that his father had been instantly killed.

F. Eber, a pioneer well-to-do resident of San Leandro, was killed last night, and A. C. Vargas of the same place, injured, when an electric car smashed into their buggy, on the San road. The men were hurled twenty feet.

Eber, an aged man, struck on his head. His skull was fractured, and he died on the car that struck him while be ing taken to Oakland. Vargas was re moved to the hospital. Tong War Reaches NOGALES (Ariz.) Dec. 4.

The United States Pacific fleet, Rear-Admiral Sebree commanding, has completed its practice off Olongapo, and will return here on Monday.
