The SIN National Spanish Television Network began operating Sunday on Channel 42, which SIN will use until the Federal Communications Commission designates a licensee for the station. The SIN programming will be identical to cable Channel 13 and will not carry local commercials or programs. Viewers within 20 miles of Austin will be able to receive Channel will operate as a low-power station, an SIN spokeswoman in New York City said. Nevertheless, critics say Clayton's decision once again shows the weakness of the state's political contribution and spending laws that allow a candidate or officeholder to use political donations in any way he sees fit, Including personal uses, so long as it is reported to the secretary of state.

Clayton said Monday he had pumped a third of $1 million into his campaign treasury to run for for state land commissioner and has no intention of returning the money to donors. While Clayton said he had not yet decided how to spend the money, he pointed out he has a year left as speaker, and left open the possibility that he would run for office in the future. State law permits him to spend the money on anything he wants business, personal, political or otherwise and it's that total lack of restrictions on how the money can be used that has aroused criticism. A bill banning the use of campaign money for personal uses failed in the 1981 legislative session. Common Cause of Texas "considers it unethical to convert campaign funds for personal use or investment," said John Hildreth, executive director.

The law should ban personal use of political donations "primarily because it raises the appearance of un- ethical conduct," he said. Hildreth added, however, that it "would be premature to say Speaker Clayton is guilty of unethical conduct." Dr. Bill Forbus, chairman of the Texas Dental Association's political action committee, which gave $1,000 to Clayton's Dec. 4 fund-raiser billed "Texas Salutes Bill Clayton," said, "I don't have any hard feelings and I don't think our board would or our membership." Clayton said that the fund-raiser wasn't billed as a campaign effort and money not solicited on that basis. Records on file with the secretary of state's office shows that $75,000 from that fund-raiser, which snared $123,405 in contributions, was transferred to the Bill Clayton Campaign Committee.

Lloyd Hayes, a former mayor of Port Arthur who contributed $500 to the fund-raiser, said he "had no objection at all" to the speaker's keeping the money. "In fact, I think it's good he keeps his options open."
