At issue will be constitutional freedoms of speech and press and an unprecedented interpretation of espionage laws.

Already history records this as the first case in which men were charged with espionage for leaking secrets to a newspaper. "This is a nontraditional espionage case," says Ellsberg's defense attorney, Leonard Bou- din. are writing here on a clean slate." Espionage, Boudin says, usually involves spies. The laws themselves refer to persons "obtaining information respecting the national defense with intent or reason to believe that the information is to be used to the injury of the United States, or to the advantage of any foreign nation." That phrase, however, is omitted from the federal grand jury indictment of Ellsberg and Russo. The defense contends espionage laws can't be interpreted to exclude intent to harm the country.

The Jusice Department says they can. The government doesnt claim that either Ellsberg or $095 95 Russo intended to harm the United States when they made public the massive Pentagon Papers a government study of the origins of the Vietnam war and the decisions that prolonged it. Ellsberg, 41, lean, intense and graying, and Russo, 35, balding, amiable and soft-spoken, are both former researchers for Rand Corp. at Santa Monica, a "think tank" which researched war-related projects for the Pentagon. At Rand, Ellsberg, then a top-rated war analyst, gained access to the 47-volume Vietnam study.

Both Ellsberg and Russo have said they discussed the study together, gradually drifting from hawkish approval of the Vietnam war to disillusionment and a desire to end the conflict. Ellsberg has taken full responsibility for making the papers public, although Russo has said he helped copy them. Russo is charged in only three counts of the 15-count in dictment. Ellsberg is named in 12 counts. Conviction could result in a maximum sentence of 115 years in prison for Ellsberg and 35 years for Russo.

"I took the action on my own initiative," said Ellsberg when he surrendered to authorities June 28, 1971. "I felt as an American citizen as a responsible citizen I could no longer cooperate with concealing this information from the American people." He added, "I am prepared for all consequences." However, he says now that he feels he broke no laws. The first article gleaned from the Pentagon Papers appeared in the New York Times on June 13, 1971, and led to an immediate court battle over freedom of the press to publish the material. Following restraining orders, appearance of the documents in more newspapers and a flurry of court appeals, the U.S. Supreme Court ruled there could be no prior government re straint of a paper to bar it from publishing a story.

However, it did not bar the government from attempting prosecution. However, the Los Angeles indictment does not charge Russo or Ellsberg with giving the papers to The New York Times. Instead, it accuses them of conspiring to steal the documents, and Ellsberg is accused of improperly conveying them to "persons not entitled to receive them." The receivers named are Russo and two unin-dicted co-conspirators, Linda Sinay, who has said the documents were copied on her Xerox machine, and Vu Van Thai, a former South Vietnamese ambassador to the United States. Jury selection, which opens the trial, is expected to be speedy. St.

Olafur Jens Si-gurdsson said in a religious broadcast that Fischer, the American challenger for the world championship here, was guilty of the "sin of greed" and Soviet titleholder Spassky the "sin of anger." The clergyman's reference to Fischer's alleged "greed" recalled the American's threat to wreck the 24-game series unless the Icelanders gave him more money. Spassky's anger was shown in the world champion's threat to walk out unless he got an apology from Fischer for delaying the match over money. The match is the talk of Iceland. The sentiment seemed to favor Spassky. Fischer's behavior appeared to have eroded his early position as the popular favorite in a place where the Russians aren't very well liked.
