Contractor Declares New Jersey Chan- cellor Used His Power to Aid In Consummation of Fraud Involving Over a Million Dollars. Washington. Mahlou Pitney, chancellor of the state of Now Jersey and President Taft's uora- Jiifp I'or ViVnnc on the United States supremo court, used the power of his to aid in the consummation of a traud which, in its entirety, he claims, involves is the chance made by Michael McManus, a. Philadelphia coiittactor. Protests against Pitney'a appointment to the supreme court have beeu filed by Me Manns with the president and the senate.

In these protests ihe specific charge made by Me Mamis against Pitney is a in a case in which his brother-in- law was counsel for one party and in which an order defeating that party had already been made, he set aside the decree of a former vice chancellor without due process. It is- also charged that the name of Vice Chancellor M. P. Grey was signed Pitney's order, athough Clrey had been dead four years. That part of the alleged fraud in which MsManiiB' accusation involves Pitney relates to the foreclosure of a nioruraRe on Gloucester.

McManus declares that during liUO Pitney had become chancellor, counsel for the hankers moved to set iside Grey's decree. The bank was represented in 'his case by George R. VanDusen, who is a brother-in-law to Pitney, and a decision wiping out the Grey decision was ordered by the court. The decision against McManus is signed, it is alleged, by Pitney and ilso bears the signature of Vice Chan- c-ellor Grey. It is dated January 25.
