New York, March intimations are mado by anthracite operators that intervention by a third party In tMemen ot Sauiuel Pearson and Nat Smith, tho two colored men accused ot chicken stealing, were found guilty on both counts of larceny, but not of receiving stolen goods. The fondness for fowl proved to be the undoing of these unfortunates, and their testimony was sufficient to break the web of evidence that tho Commonwealth wound arpund them. Following this case a very tangled one was presented In the large court room.

In this case Andy Litvany and Paul Shoppo were charged by J. E. Emerson with the larceny of a horse. This case was very much muddled. It appeared that LJtvany owned the horse, which ho sold to Sheppo for $150.

On January 26 Sheppo closed the' deal with Lltvany by paying him $40, and the same evening Sheppo took the horse. Sheppo claims that Emerson Joiew that Litvany was going to sell it. Sheppo is employed as engineer on the dinkey at Lelsen- ring No. 2. About the time that this deal was consummated, Emerson paid a bill of $43.15 that Lltvany owed Cornish Brothers, liverymen.

Sheppo brought the horse to Unlontown about a week after he had purchased it, to see a veterinary about having the animal treated for lameness. When ho came later and took the horse away, Emerson immediately made information against Lltvany and Sheppo for larceny and secured the animal. Emerson claims that the horse Is his by virtue of paying Litvany's debt to Cornish Brothers, while Litvany asserts that he sold the animal to Shepyo. Attorney George B. Jeffries is assisting District Attorney Hudson in prosecuting the case, while Attorneys A.

E. Jones and R. P. Kennedy are for the defendants. All Monday afternoon was taken up with hearing witnesses.

A verdict of not guilty was rendered in the case. In room No. 1, before Judge 'Umbel, District Attorney Hudson began the prosecution of Alvle C.
