STEINBERG SRW, a fledgling firm whose principals had no background in broadcasting, filed Its challenge to WYST's license in 1981, when the station, which broadcasts at 92.3 on the FM dial, was known as WLPL. It was one of several challenges mounted against licenses owned by United stations around the country following FCC decisions to strip the company of licenses it held for stations in Miami and Washington. The FCC action resulted from violations of federal broadcast regulations In the early 1970s. In his January ruling favoring the application of SRW over that of WYST, Frederic A.

Coufal. the FCC administrative law Judge, criticized' WYST's "mediocre record" for news and public affairs programming. He further faulted the station for duplicating its non-entertainment programming on its sister station, WYST-AM, which was not challenged In the case. United appealed Mr. Coufal's ruling to a three-member FCC review board, and the FCC's own Mass Media Bureau filed an exception to the ruling, contending that Mr.

Coufal had misinterpreted the law In considering the duplication of public affairs programming on WYST's AM and FM stations against United's renewal application. In fact, said a spokesman for the Mass Media Bureau, the FCC has ruled that such programming duplication is acceptable. In addition, in the months before the SRW-United settlement, challenges to five other United stations had been denied at either the administrative law Judge or review board level, the spokesman said. Asked whether the earlier denials had Influenced his decision not to continue to pursue WYST's license, Mr. Steinberg, who has represented a Northwest Baltimore district in the state legislature since 1966, said.

"Sure." United's Mr. Hroblak said that in each of the other five cases, the company eventually settled with the challenger to prevent further appeals within the FCC or to the U.S. Court of Appeals. The settlements ranged from $55,000 paid to a challenger to the company's AM and FM outlets in Cleveland to $387,000 paid to two challengers to KSOL-FM In San Mateo. he said.

Mr. Hroblak said he was willing to pay more to settle the challenge to WYST because It was "the last case that remained open" and because the station is a "very valuable property to the chain." Until recently, the size of settlements of cases before the FCC was limited by federal law to legal and other out-of-pocket expenses, and a detailed accounting was required before such payments could be approved. Those limitations and accounting requirements were dropped in the early 1980s. Under the terms of the SRW-United settlement. SRW agreed to drop Its application to establish a station on the frequency used by WYST and to refrain from competing for that license for at least 1 0 years In return for the cash payment from United.

Mr. Hroblak said United doesn't have "any new plans for the station now that the license challenge has been settled. "Obviously, we're always trying to make it better," he sa'd. For his part. Mr.

Steinberg said he doesn't feel "that bad" about the way his challenge turned out and that his company Is going "back to the drawing board" in an attempt to break into broadcasting. He said he is looking at the possibility of buying an FM station in the mid-Atlantic region or applying for a permit to operate a station on a new frequency becoming available In the Cambridge area. "I was very attracted to the challenge of this type of business venture." he said. Broadcasting is "a very exciting economic venture. I certainly don Intend to be an elected official the rest of my life."
