Surety Company Gets Judgment Per $57,040 Against Macedonia The American Surety Company of New York Wednesday afternoon was awarded a $57,040.63 judgment against William H. and Ruth A. Pilling of Macedonia in Federal Court here. It was the full amount the surety company had sought. U.

S. Circuit Judge Charles E. Whittaker also ruled the company was entitled to five per cent interest from April 1, 1948. The surety a had charged that between July 18, -1945, and March 20, 1948, the Fillings had drawn 17 checks on their account in the Macedonia office of the State Savings Bank. Claimed False Entries The surety company contended that deposits in the account were not sufficient to cover the checks.

To cover the checks, the company claimed, Donald E. Roarty, former manager of the Macedonia 'office, made false credit entries in the Pilling account The 'bank had to expend 797.70 to correct the false entries and restore the funds used to pay the checks, the surety company contended. Judge Whittaker held this involved either holding insufficient funds checks as cash items -when they were not cash or the false transfer of funds-from other accounts to the Pilling account to make it appear sufficient money was on hand to meet, the obligations. Judge Whittaker held this was a mutilation and a falsification of the bank records in which Roarty and Mr. and Mrs. Pilling "abetted" and each became "jointly and severally liable." Pilling Found Innocent Pilling and Roarty were indicted in 1948 for violation of the national banking act.

Pilling stood trial and was found innocent of the charge by a jury on March 23, 1949. Roarty pleaded guilty and was fined a total of 52,000 on five counts, according to the Federal Court records. The surety company also holds a 557.043.63 judgment against Roarty. Judge Whittaker denied the request of the surety company to set aside deeds on property by the Pillings to tKeir two sons. One deed was given to Doyle H.

Pilling Oct. 29, 1947, the other to Laverne B. Pilling, June 29, 1950. Judge Whittaker held that at the time of the conveyances the sons did not have any knowledge of "the bank, record machinations."
