Gov. Cox today pardoned George K. Cetone, of Dayton from the penitentiary where he was serving a three year term following conviction in the Franklin county courts in December 1912, of accepting a bribe while state Senator Cetone has been at the prison farm, near London, Madison county for some time he has been suffering from rheumatism. Cetone was convicted of accepting 8 $200 bribe from Harrison Smiley, Burns detective, at the Chittenden Hotel. Smiley posed as a legislative lobbyist, desiring the enactment of legislation.

At time the money changed hands, the conversation was taken down in short hand through a dictagraph and later used as evidence against Cetone. At the time Cetone was indicted, similar indictments: were Isaac returned against of Butler state Senators Huffman, county and L. R. Andrews of Lawrence county and Rodney Diegle, sergeant at arms of the Senate, who with Cetone at the Chittenden Hotel. This same dictagraph evidence was used in convincing dence was used in convicting Huffman, Andrews and Diegle, Andrews served nine months in the pen and was released some time ago.

Huffman and Diegle were both sentenced to three years imprisonment, Huffman is still in the big prison. Diegle served his time. While announcing Cetone's pardon, Gov. Cox gave out the following statement, "In granting this pardon we are moved by these considerations. Attorney General Hogan, were prosecuted all of the legislative bribery cases makes the unqualified statement that in the entened Grand Jury investigations there was not a scrap of evidence against Mr.

Cetone except that which grew out of the entrapment proceedings, meaning the dictagraph evidence. man had led, previously, a blameless life. He is now in poor health, in fact, he required the use of a crutch or cane when he entered the prison. He has been a perfect prisoner, and while he has protected his innocence from the outside, he has manifested on bitterness that gave the least annoyance to the warden. His wife and little boy ask for him now that he may be taken to Hot Springs, in the hope that his health may be recovered.

His term would legally expire months from the first of the year. "We are not allowed, elther by law or precedent, to speak of things that take place in the Grand Juryroom, but, it is almost common knowledge that while 10 evidence was gathered against Mr. Cetone except that joining the entrapment, in practically every case that was submitted for Investigamotion, the of the trial at lobbyist. once revealed the "The lobbyist is the real culprit, but so cleverly was his work concealed that conviction would have been impossible. He.

therefore, stalks about a free man with a brazen contempt for the law. I believe the interests of siciety will be conserved by the release of Mr. Cetone but, in giving him his freedom wish the power were inherent in the station I occupy to put in his place the lobbyist or lobbyists who in fact made the real contribution to the shame and humiliation of the state."
