In Birren EX-JAZZ BAND LEADER, DIES Had Discovered Many All-Time Greats Jean Goldkette, 63, one time top band leader who discovered some of the all-time jazz greats, died yesterday in Santa Barbara, CaL, of an apparent heart attack. In recent years, Goldkette had lived in Los Angeles. For two years, beginning about 1928, Goldkette was director of the W-G-N studio orchestra, when the station had studios in the Drake hotel.

Discovered Tommy Dorsey Altho sot a jazz musician himself, Goldkette discovered such prominent band figures as Tommy Dorsey, Glen Miller, Artie Shaw, and Glen Gray. During his years as a bandleader, he employed such all-time greats as Bix Bieder-becke, the king of the jazz trumpet players; Joe Venuti, Eddie Lang, Frank Trumbauer, Danny Polo, Jimmy McPart-land, and Hoagy Carmichael He had his own band in New York City and Detroit in the 1920s, and also played a major part in organizing and booking other bands. He once had 63 dance bands operating in the Detroit area. Born in France Born in Valenciennes, France, Goldkette was reared in Greece, and trained as a concert pianist in Russia. He came to the United States in 1911.

Ia the 1940s, he turned to the concert circuit as a pianist, performing in Carnegie hall and with the Detroit Symphony orchestra. In 1923 he opened the Gray-stone ballroom in Detroit and organized what Metronome magazine later called "the band that rocked the nation." In recent years he served as president of the National Artists Foundation of Detroit, a nonprofit organization which aids promising young performers in various fields. Goldkette had been a widower for years, and had no children. BOY, 15, SLAIN OVER PEANUT MACHINE THEFT Store Owner's Son Held for Shooting The state's attorney's office yesterday ordered a voluntary manslaughter charge lodged against a 17 year old youth who earlier shot and killed a boy, 15, he accused of stealing a peanut machine. Robert Shed of 862 Sedg wick was Alphonss House Jr.

shot in the back of the head by Alphonso House Jr. of 36 S. Homan with a .303 caliber British jungle rifle as, House said, Shed fled with the vending machine from the cleaning oper ated by House father at 1269 Clybourn av. Alone In Store Young House told police he was alone in the store when several boys began peeking in windows and heckling him. He said Shed and another boy came into the store.

He said Shed grabbed the machine and ran out the door. The House boy said he took the rifle, kept beneath a counter for protection, and fired thru the open door at Shed, who fell dead on the sidewalk with the machine beside him. The machine contained pennies and nickels totaling less than $3 which had been placed in the machine to obtain peanuts and candy. Charged Pending Inquiry State's Atty. Daniel Ward said the charge was ordered placed against young House, "pending completion of the investigation." The investigation so far, Ward said, indicated there was no legal justification for the killing.

He noted young House apparently was in no physical danger at the time, as the boy Was not armed and was running away. The new criminal code, effective Jan. 1, provides penalty of one to 20 years imprisonment on conviction of voluntary manslaughter.
