If an answer leads to an incorrect tax return and the taxpayer produces such a record, Le-Baube said, the IRS will waive any penalty. The subcommittee, chaired by Rep. "However, the assistor would in all probability be providing an answer that would allow the taxpayer to prepare his return correctly." After the GAO refused to change its scoring method to accept such responses as correct, the IRS decided on its own to count them as right.

Without informing the GAO, the IRS held a news conference last Friday to announce that assistors were giving the correct answer 69.2 percent of the time.
