Balan 17.96 NL A growing move is under way in the United States today to deny more and more of your claims access to the courts. Some members of the courts themselves say they are overburdened with too many cases and should be given a breathing spell.

And of course, most industries feel they are pestered by too many lawsuits. What kinds of cases are affected by this destructive trend and how are you affected? Here are just three of the many ways: 1) If you are robbed, mugged or assaulted, you are affected. If the courts can't handle the case, the district attorney accepts a plea to a minor charge just to move the calendar, putting the criminal right back on the street 2) If you buy a "lemon" product and want your money back or your debt canceled, you may get less legal assistance or sympathy in court than in the 1970s. 3) If you are injured in an accident, chances are better in some areas that the insurance company will know it will be tough for you to get to trial if you sue, so it may offer a lower settlement. How can this happen in our society? Because we've been programmed into resignation by a series of events beginning with the double gas-line crisis and continuing into this period of trying to explain a complaint to a store's computer.

And because the judicial doors are being shut by impeccable tools. The experts have logical rules for everything they claim. "We are very busy, so go away." The idea that the workload of a court is a valid reason for turning away citizens is new. The assumption always has been that if a case was valid, the legal machinery had to be used to solve it. Now it's quite trendy to say in legal opinions, "To allow this sort of case would generate a great deal of additional litigation that might overburden us, so we rule there is no such claim recognized in this court." Once you accept that assumption, you go straight down the drain.

"Our dockets are very crowded." 17 GROWTH IN ASSETS 11 GROWTH IN RETAINED EARNINGS SHARON 1981 CONSOLIDATED FINANCIAL STATEMENT The computer didn't improve the workings of the court system for the citizen. It improved the workings of the printouts. Many old cases involved matters that the parties themselves had no desire to move. But neither party wanted to admit defeat, so the file was left in the basement. Highlighting these cases has created emergencies and overlooked the pur-, pose of the courts to serve society, not to boast of housekeeping efficiency.

"Frivolous cases are a terrible sin." Because dockets are so important, new rules would require lawyers to sign, in effect, an oath certifying that instead of taking their clients' word, they have done their own impartial investigation of a case before troubling the courts. But who decides whether a case is silly and a waste of the busy court's time? The court, of course. Another approach to stopping pesky lawsuits is the trend to charge the legal fees of the defending party to the one who had the nerve to sue or even the attorney who takes the case. "Lawyers need more training, especially young ones." Making it harder for newcomers to get in has the double merit of giving more business to the "ins" while keeping out troublesome entrants who may be willing to try nettlesome new arguments that might add to the workload. These are merely a few of the unimpeachable doctrines permitting judicial door slamming.

There are many other equally polished, even posh lines of thought leading to the same conclusion delightful both to those who want the courts to be less busy and to those who don't want to be sued. Kravetz and New Vision may well be the underdog-made-good in the Baltimore pay-TV market. In 1977, he filed with the Federal Communications Commission to bring subscription television here.

Last year, Channel 45 WBFF also filed with the FCC to convert its prime-time broadcasting to a pay format. Kravetz has petitioned the FCC to deny Channel 45's plan to become a subscription operation. The FCC is still considering the request, which is based on the commission's comple-ment-of-f our rule. The rule states that an applicant can only operate subscription television when a community receives Grade A signals a technical judgement of signal strength by the FCC from four other free commercial stations. Baltimore currently receives Grade A coverage from home-based Channels 2 WMAR, 13 WJZ, 11 WBAL and 45 WBFF, But Channel 45, in seeking to shift to pay-TV, has asked the FCC to waive the comple-mentof-four rule.

Salditch has little doubt that even- tually the FCC will license others to air pay programming. "Deregulation is inevitable," says Salditch. "Once the commission decides to move, the complement-of-four rule will be one of the first things to go. Once it's removed, anybody can gotoSTV. "But we do feel that because of certain problems with Channel 45, the commission would have reason to deny.

We question their Channel 45 business practices," Salditch adds. But Salditch feels confident that Channel 54 will not only lead the way, but guide the future in the realm of pay-TV. "Whoever is first with STV will have the majority of the market. Whoever is second will always be second," says Salditch. "If we can establish ourselves now, we will be here by the time DBS Direct Broadcasting Satellite direct satellite transmissions to individual homes comes." Salditch insists that pay-TV will not be affected by cable television systems: "We don't compete with cable.

Everyone talks about it being a really exciting thing and it is. But it will never wire the entire country. There are places where it is so per capita, for a cable operator to wire that it is just not financially feasible."
