Nov. 17 per cent. of the Democrats in West Virginia are for Al Smith for the Democratic nomination President, according to C. W. Osenton, of Fayetteville, West Virginia member of the Democratic National Committee, who predicts that there will not be more than five ballots at the national convention and that Smith will be the choice of the party.

People are thinking and talking about nothing but prohibition, said the Democratic leader, and prohibition will be one of the major issues of the campaign. "Nearly everybody favors modification," he concluded, "although many people are afraid to speak above a whisper in mentioning it. I do not know that Governor Smith, as President, would to Congress a modification law, but I'll recommend, wager if Congress passed such an act he would sign it." Col. Harry A. Guggenheim and Hugh Sproul, of Staunton, enjoyed an oldfashioned Virginia dinner in a farmhouse on one of the Byrd orchards. Colonel Lindbergh and his hosts flew from the mountain camp of Hugh Sproul, in Augusta, to the Byrd orchard. A driving rainstorm blew over the Shenandoah Valley today, interfering with bunting. Prospects are for better weather tomorrow.

Dr. J. J. Muir, Chaplin Of U.S. Senate, Is Dead Noted Clergyman Passes With Heart, Attack After Address.

He Was 80, Washington, Nov. 17 chaplain of the United States Senate, the Rev. Dr. Joseph Johnstone Muir, widely known Baptist clergyman, died at his residence here early today at the age of 80. years.

Heart disease was the cause of death. Dr. Muir spoke last night before association of Baptist Churches of the District of Columbia, but was taken suddenly ill about 2 o'clock this morning and died in half an hour. Although born in Ireland, Dr. Muir was of Scottish ancestry.

He was educated in private schools Ireland and Scotland and ordained in 1869, four years after coming to the United States. THE SUN, BALTIMORE, FRIDAY DECISION DUE SOON ON WHEELING ROAD Sponsors Of Fifth Trunk Line Plan Await Action On I. C. C. Examiners' Report.

APPROVAL HELD LIKELY Such Disposition Of Controversy May Have Bearing On W. Md. Road, It Is Suggested. Bureau of The Washington, Nov. the Interstate Commerce Commission sustains yesterday's report of its examiners in the Wheeling and Lake Erie case, such action would be regarded generally as official notice to the Eastern railroads that the fifth trunk-line plan was sound.

The report would bar from the Wheeling board representatives of the Baltimore and Ohio, the Nickel Plate and the New York Central on the general ground that the Wheeling should not be made an integral part of a three-system scheme at this stage, if at all. Approval Still Wanting. It is significantly pointed out by the commission's examiners that the Wheeling and Erie was made part of a fifth system in the original Ripley plan of consolidations, and it is now being sought by the LoreeTaplin interests as part of a system they would erect around the Wabash, the Lehigh Valley and the Pittsburgh and West Virginia. The report of the examiners, it should be remembered, has not been approved by the commission and has no force until it is so approved. But it is well known that the commission gives most serious consideration to the findings of its examiners and oftener than not concurs in them, particularly when two sit in a case, the Wheeling and Lake Erie hearing.

May Have Bearing On W. Md. In a few weeks the commission will pass finally on the question of the Wheeling's future, and if the three roads now having stock control of that line must surrender their holdings, those interests promoting the fifth trunk line undoubtedly would reach for it, observers here believe. Incidentally, such decision by the commission probably would have direct bearing on the future of the Western Maryland. The Rockefeller holdings in that road were taken over by the Baltimore and Ohio as part of the deal whereby the Van Sweringens gained control of the Wheeling, a control which these brothers divided with the Baltimore and Ohio and the New York Central.

Should the commission find it inadvisable to turn over the Wheeling and Lake Erie to the Baltimore and Ohio, the Nickel Plate and the New York Central, either on the ground that it was illegally acquired or on the ground that it should be reserved as part of a fifth system, the same reasoning might be applied to the Western Maryland. Watson, Republican, Indiana, denied that he had attempted to influence the Indiana Supreme Court in behalf of Dr. E. S. Shumaker, superintendent of the Anti-Saloon League of that State, who was brought before the court and sentenced to jail on contempt charges. The deposition is to be used in further hearings at Indianapolis on the motion of Arthur L.

Gilliom, AttorneyGeneral of Indiana, to increase Shumaker's sentence. Corroborated By H. L. Wilson. In another deposition taken here today Henry Lane Wilson corroborated the Senator's account of a telephone conversation he had with Shumaker when Watson was at the Indianapolis home of Senator Robinson, Watson's colleague.

Shumaker requested him, Watson's deposition said, to use his influence to have the Republican 1 State committee called for the purpose of denouncing Gilliom. This he declined to do, the Senator testified under questioning by the young Attorney-General. A threat that the "Anti-Saloon League and Methodist Church will hold you responsible if this thing isn't done" was made by Shumaker, Watson said. Denies Approaching Judges. Watson further asserted that had refused to approach any of he also judges in Shumaker's behalf, declaring emphatically that he never had discussed a pending case with any judge.

Reiterating his emphatic denial that he had discussed the case with any members of the State Supreme Court, Watson said that the only action he has taken was to write on his own initiative to two men in Indiana, whom he characterized as very close personal friends of the Attorney-General, asking them to use their influence in having Gilliom relent in his demand for imprisonment. Shumaker Is Silent On "Threat" To Watson Indianapolis, Nov. 17 James E. Watson never attempted to influence the Indiana Supreme Court in its action against him for indirect contempt of court, Dr. E.

S. Shumaker, superintendent of the Indiana Anti-Saloon League, here today, commenting on the deposition of the Indiana Senator, made at Washington. Dr. Shumaker refused, however, to affirm or deny the truth of Senator Watson's allegation that Shumaker had made a threat that the "AntiSaloon League and Methodist Church will hold you responsible if this thing isn't done." The Indiana dry leader, under sentence by the Supreme Court for contempt in connection with published statements that the court was prejudiced in liquor cases, said any comment he might make would be given only in case he were to testify in court. Dr.

Shumaker's next appearance before the court will be Monday, when arguments will be heard on a motion by Arthur L. Gilliom, Attorney-General of Indiana, to increase the sentence "because of corrupt attempts by Shumaker to corruptly influence the decisions of the court."
