Garrett, first secretary of the United States Embassy at Rome, has purchased Blythewood from W. W. Edmondson, trustee, at a price said to be about $70,000. The property consists of about 32 acres of rolling land dotted with large and handsome shade trees. The improvements include two mansions and all nec essary outbuildings.

The tract is located on Charles street extended, north of Cold Spring lane, and reaches as far east as the Maryland and Pennsylvania railroad and west to Roland Park. It is directly opposite Evergreen, the beutiful home of Mr. Garrett's mother, Mrs. T. Harrison Garrett, and also adjoins Wyndhurst, the home of Mr.

and Mrs. Robert Garrett. Mr. Garrett, who has been here for the last month, will sail for Italy next Tuesday. The transaction was made through the office of Baldwin Frlck.

The Baltimore County School Commis sioners are having plans prepared for a one-story frame school building to be erected at Wilhelm Park. The structure will be 30 by 50 feet and will be modern in every particular. Bids will be received on June 29. The following builders are estimating: G. W.

Lovell, W. E. Burn-ham, W. C. Espey and Henry Nagle.

A dwelling on the north side of Twenty-fourth street, near Oak, with a lot 14 by 75 feet and subject to a ground rent of $100, has been sold to Fay P. Le Compte by Bessie L. Kelly. Clarence Cottman has transferred to Susan N. P.

Cottman a three-story dwelling on the south side of Biddle street, near Maryland avenue, in fee. The lot is 16 by 100 feet. A ground rent of $360 issuing from a lot at 211 West Camden street has, been purchased by the trustees of the Samuel Ready School for Female Orphans from William R. Cox for $9,000. The lot has a frontage on Camden Btreet of 54 feet, with a depth of 157 feet, and is improved with a three-story Bids for the addition to the country school at Mount Winans will be received by the Baltimore" County School Commissioners up to June 29.

The structure will be two and one-balf stories high and measure 26 by 48 feet. Michael Jacobson has purchased from the Fidelity and Deposit Company the two leasehold properties 809 and 811 East Forty-first street. Each house Is subject to a ground Tent of $65, and each lot measures 23 feet by a depth of 100 feet. Madison E. Lloyd was the attorney for the purchaser, and the title was examined and guaranteed by the Title Guarante Company.

Attorney-General Isaac Lobe Straus yes terday gave a score of opinions touching many important legal questions. He spent the entire day at work on the problems which had been referred to him.

Mr. Straus holds that the bills amending the charters of the Commercial Savings Bank of Cumberland and the Fidelity Savings Bank of Frostburg are both illegal. The bilU were -passed by the Legislature. In reaching this conclusion Mr. Straus said' that the subjects were not properly described in the title and that the bills were so vague and confused as to be without that certainty and intelligibility necessary to a1 valid -statute.

Both institutions are already in operation, the object of the new legislation being to give them broader powers. At the request of State's Attorney Stifler, of Harford Mr. Straus passed upon the legal fight which has' been going on for some months between Clerk of the Court John A. Robinson and former Clerk William S. Forward.

The opinion also affects every incoming and outgoing Clerk of the Court and Register of Wills in the State. Mr. Robinson succeeded Mr. Forward and they disagreed in regard to the completion of the work of the office and the collection of the fees. Mr.

Straus holds that the retiring clerk should be allowed six months from the date of his retirement to complete the unfinished work of his office, for which he should receive the fees. During that period of six months the retiring clerk has the right to collect money due the office for the work done in his term or completed by him in the six months, subject to the right of the State or the Comptroller's office. The new clerk is entitled to the account books of the former clerk containing fee accounts of the office. In an opinion to State's Attorney Wil-lard, of Frederick county, Mr. Straus holds that the purchasers of a distillery or stock of liquors must take out licenses under the State law in order to sell the liquors which they purchased.

He sent an opinion to Adjutant-General Warfield concerning the right of officers of the Veteran Corps of the Fifth Maryland Regiment be placed on the retired list. The last Legislature passed a joint resolution requesting the Attorney-General to test the question of the jurisdiction of the State cn the Conduit road, which runs from Washington through Montgomery county. Mr. Straus has named Mr. Robert B.

Peter, of Montgomery county, as assist ant counsel in the case. Court proceedings will be Instituted within a few months. GETS $21.000 FROM ESTATE Judge Nile Awards Nicholas Mar-key Deposits In Banks. In an opinion rendered yesterday Judge Niles, In the Circuit Court, decided that Nicholas Markey, the executor for the estate of the late Mrs. Rose C.

Markey, was the owner of $11,000 on, deposit in the Eutaw Savings Bank, $5,000 in the Central Savings Bank and $5,000 in stock in the Alabama Home Building and Loan Association. At the death of Dr. Joseph E. Clagett the money and stock stood in the joint names of Dr. Clagett and Mrs.

Markey, who was his daughter, "to belong to the survivor," and both were claimed by Alexander H. Robertson, administrator of Dr. Clagett, on the ground that, although Mrs. Markey survived her father, the latter had never perfected the transfer. The account in the Central Savings Bank was In the "in trust" form, which has been approved by the Court of Appeals, but the Eutaw Savings Bank account and the stock read "subject to the order of either and at the death of either to belong to the Messrs.

Edwin G. Baetjer and Alfred Bagby, were counsel for Mrs. Markey's estate. Messrs. Alexander II.

Robertson and Bernard Carter represented Dr. Clagett's estate. It is said the case will probably go to the Court of Appeals. The Banking law passed by the last Legislature provided that where a Joint bank account is made payable to the survivor the bank can safely pay the balance to the survivor without proof of ownership of the money. to REDEEM OLD BONDS Bill Refunding: $2,000 To Schermer Estate Passes Congress.

A special dispatch to The Sex from its Washington Bureau says A Maryland bill with an interesting 6tory back of it was passed by the Senate yesterday afternoon, being called up by Senator John Walter Smith and put through by him in the middle of the filibuster on the Appalachian bill. The measure was introduced in the House by Congressman Talbott, who secured its passage there and had interested both Senators Smith and Rayner in it in the Senate. It is entitled a bill "for the relief of the estate of John V. Schermer," and requires the United States Treasury to redeem two United States bonds belonging to that estate. These bonds are known as consols, of 1865, which issue' was called for redemption by the Government in 1899.

They were formerly owned 'by John V. Schermer, of Baltimore, and were given by him for safekeeping to Ernest Neurath, also of Baltimore. In 1876 they were stolen, it la alleged, by Mary Miller, who broke into the house of Mr. Neurath, at Park avenue and Fayette street. She was arrested, convicted and served a term in the penitentiary.

The bonds were never recovered and have never been presented for payment. Mr. Schermer died in Baltimore in 1681. The bonds are valued at $1,000 each and the Treasury Department takes the stand that it has no authority to redeem them now without the direction of Congress. The Schermer estate is represented by Albert C.

Former Baltimorean Hurt. Mr. C. E. Trlplett, formerly of Balti-i more, and now assistant manager of the Harlem Central Hotel, New York, was badly cut by breaking a glass door Thursday afternoon.

A report Is current that employes III State and municipal offices who are members of the Maryland National Guard will not be granted leaves of absence to enable them to take part In the encampment at Gettysburg July 1 to 9. When this was brought to the attention of Major-General Henry M. Warfield yesterday, he said "I have not as yet received notification that any of the city or State officials have refused to grant leave of absence to the members of the National Guard in their departments.

If these officials should decline to permit the members of the Guard in their offices to attend the encampment, I should deeply regret It. I shall, no doubt, receive word in the next few days if this is the case. Should I receive notification, I would at once take the subject up with the proper city and State officials and endeavor to point out to them the Importance of granting the members of the Guard In their employ the right to attend the encampment. "It is highly important these men should be permitted to go to this encampment. They are the men who would be called upon to protect the State in time of trouble.

It Is necessary that they should be given an opportunity to receive instruction in the war game. These men get only a week's training each year, and if they miss "this, they have their weekly drills only to develop them in this respect." Mayor Mahooi said: "I am willing to co-operate with General Warfield. I shall be glad to issue an order similar to the one I gave out last year which urged the heads of the various departments to allow employes who were members' of the National Guard leaves of absence in order that they might attend the encampment. There might arise certain emergencies in the departments which would demand that a few of the members of the companies be detained. I know of no such condition at the present time, and I believe that every member of the Guard now In the city employ should be permitted to go to the encampment." It will be a lively time for the Guardsmen on the moralng of July 1.

Special trains will take the Fifth Regiment from Baltimore to the campgrounds. Troop A and Company of the Hospital Corps, will also go to Gettysburg that mornlngr. The First Regiment, from the Eastern Shore and Southern Maryland, will come to Baltimore on the preceding day and will leave for the camp about the same time. WARDEN WEYLER DENIES IT Replies To Attaek Made In Federation Of Labor Publication. Another attack is made on Warden Wey-Ier, of the penitentiary, In the National Federation of Labor publication.

He Is accused of having an account of $1,100 with the Baltimore Boot and Shoe Manufacturing Company. An editorial In this month's issue says "In addition, might it not be a profitable source of investigation for either the board of directors or perhaps some more impartial authority to investigate the books of the Baltimore Boot and Shoe Manufacturing Company and see whether there Is not a charge account of $1,100 to Warden Weyler, and Investigate the books of other manufacturing concerns having contracts with the Maryland Penitentiary for prison labor, whether thera are not other sums of money charged to Warden Weyler's account? To ascertain whether there was not a change from the personal account of Mr. Weyler to a debit and credit, profit and loss account for the defeat of legislation regulating prison labor then pending before the Congress of the United States?" "I brand this statement a lie," said Warden Weyler yesterday. "It's so ridiculous that It makes me laugh. My books are open, as is my institution, and I defy anyone lo prove that there Is anything wrong at the Maryland Penitentiary.

If any firm has any book which will show that I have-an account there, the members of the firm can explain why my name is on the hook. As far as the Baltimore Boot and Shoe Manufacturing Company is concerned I would like to say that Mr. Samuel Gompers, president of the federation, tells an untruth if he says I have a personal account with the shoe company." GOVERNMENT GETS VERDICT 31 r. Graham, It Is Alleged, Did Xot Finish Granite Work By Contract. The case of the United States against Frank F.

Graham and the Title Guarantee and: Surety Company, of Scranton, one of the most important in the amount of money Involved, and one of the longest in point of duration of trial that ever came before the United States Circuit Court for Maryland, went to the Jury Friday afternoon. A sealed verdict in favor of the Government for $30,000, the full amount of the bond sued on, was rendered yesterday. The trial of this case began on June 1 and occupied nearly four weeks. It was tried before Judge Morris. The Government was represented by United States District Attorney Hill and Assistant District Attorney McLanahan.

This Is the first civil case that they havs tried for the Government since their taking Office, and at its conclusion they were complimented on Its conduct. The defendants were represented by Messrs. George R. Gaither, Charles F. Harley and Garnett T.

Clark. The suit arose out of the building of a new white granite building in Washington for the National Museum, which has been erected by the United States for the use of the Smithsonian Institution. Mr. Graham, of Baltimore, made a contract with the Government for $140,000 -for cutting the granite for the south pavilion of the building. It is claimed by the Government that he did not carry out his contract and that, having abandoned It, the Government undertook its completion, and thereafter brought suit for some $56 000, the cost of completion.

The National Museum Building cost ore $3,500,000 and was erected under the direction of Bernard R. Green, the Government civil engineer, who built the Library of Congress and the Army and Navy Building. Mr. Green was one of the most Important witnesses for the Government, and his examination consumed over a week. Dr.

Charles Walcott, the secretary of the Smithsonian Institution, was another important witness for the Government. TO HEAR REQUISITION PLEA Case Of Georgre V. J. Jones Comes Before Governor Tomorrow. Governor Crothers tomorrow will hear the application for requisition for George W.

J. Jones, who is wanted by the Harris-burg (Pa.) authorities to answer the charge of larceny of a gold watch valued at $40. At the request of former Congressman Charles R. Schirm the case will be heard in the Court of Common Pleas, in order that the lawyers may refer to law books In the discussion of legal points involved. Attorney-General Isaac Lobe Straus will represent the State, and it is probable that he will have charge of the hearing, as the Governor has several Important board meetings scheduled for the same time.

Claims 10,000 For Injuries. Mrs. Carrie Powell sued the Mount Ter-non-Woodberry Cotton Duck Company and the Consolidated Cotton Duck Company In the Superior Court yesterday, through William Colton, attorney, to recover $10,000 damages for Injuries received by her on June 8 while working in the mill of the companies at Mount Vernon. It Is alleged that she was struck in the side and severely hurt by a truck which another woman was. wheeling.

When Viola Evans, 1428 Duker alley, was arrested by Patrolman Gordon yesterday on the charge of being habitually disorderly, she confided to her friends that she would be out again In 30 days as she knew how things went in the courtroom.
