Walter Jones Jr. and entangled in federal bankruptcy proceedings should be ordered once more to bargain with a striking carpenters' union, a labor judge has ruled.

Under the order, Atlantic International partially owned by the long-time Annapolis real estate broker and banker, would also have to reimburse some workers for Thanksgiving and Christmas hams and turkeys they did not get in 1977 and for back pay for part of 1978. The ruling was handed down by Sidney J. Barban, an administrative law judge of the National Labor Relations Board. Atlantic International and two subsidiaries, making and distributing construction trailers and prefabricated buildings overseas and domestically, already have a case before the U.S. 4th Circuit Court of Appeals.

If that court upholds the companies' challenge to the right of the Baltimore Carpenters' District Council (AFL-CIO) and its Local 974 to represent workers at the plant in the Chesapeake Park industrial center in Middle River, Judge Barban's ruling would be invalidated. After nearly three years of various proceedings before the NLRB, the union called a strike April 18 in an effort to force bargaining. "We haven't lost a day's production," Edward J. Gutman, the company's labor lawyer, said. "The strike is not affecting the operations." "We are still out on strike," said Oneal Fowler, business agent for Carpenters' District Council.

"The company still refuses to bargain. About 150 strikers are still out." Judge Barban ruled last week that Atlantic International committed unfair labor practices by refusing to bargain and changing working conditions without consulting the union, which won bar gaining rights for plant workers in a close and disputed July 1976 election. "The company has challenged the results of the election since the outset," Mr. Gutman said, adding that Judge Barban's ruling will be "invalidated" if the company wins its appeals court challenge. "We are very optimistic," he said.

All the evidence and arguments considered by Judge Barban concerned events occurring long before the start of the strike. Among unilateral changes in working conditions cited were discontinuance of customary holiday bonuses of turkeys and hams and switching in 1977 from completely company-paid medical and health insurance to partial employee payment after the insurer substantially raised premiums. Judge Barban also found that Atlantic International ignored its obligation to bargain when it recalled workers at reduced wage scales after the plant was shut down and all production and maintenance workers were laid off in early 1978. In February of that year, Atlantic International and its subsidiaries filed reorganization proceedings in federal bankruptcy court to forestall foreclosure by creditors. The companies have continued to operate under court supervision while that case is pending before Bankruptcy Judge Glenn J.

Goldburn. Bankruptcy Court papers identified Jones as chairman and 40 percent owner of Atlantic International. Jones was identified in court by a federal prosecutor in 1974 as being a collector of kickback money from engineering consultants for delivery to Ag-new while Agnew was Baltimore County executive and later governor. Agnew resigned the vice presidency of the United States and pleaded no. contest to a tax charge Oct.
