J. Hayes, commission chairman, said the group awarded the date to May-wood Park instead of the Aurora Downs track because of financial benefit to the state. The commission gave Aurora Downs a fajl season altho both tracks had requested the same May 9 thru July 16 date. Last week. Circuit Judge Charles O'Connor ruled that the commission action ignored the state code which required a first come, first served treatment on date assignments.

Aurora Downs was awarded the date because it had filed its' application first. Hayes pointed out that in 1948. Maywood Park returned $267,183 in taxes to the state, whereas Aurora Downs paid $104. 994. Hayes, said that Judge O'Connor's ruling' would force the commission tor approve the first in point of time application.
