PHONE LONGBEACH 264 6. THURSDAY. jf M. It. lUhrenti i The announcement recently that i the state and the Cook county for est preserve would cooperate in constructing Ihree new dams in the Des Plaines river recalled to legal experts some all but forgotten history involving the Northwest ordinance of July 13, 1787.

This document, which enunciated some of the great, principles later embodied in the Constitution, jplied to the territory that was carved into the states of Illinois the Mississippi and St. Lawrence systems should be "common highways and forever free." States Get Water Control This statement was law so long as the Noothwest territory gov erned the land and streams. When the various states were created. however, they were given all the of ln(. stafpS! w- icinav intuitu wiiii iuuii npprovHi, io trie smie ana lecierai governments.

As late as 1920 there was a challenge to this power in regard to the Des Plaines. In the case of United States vs. Economy Power Llght company ZW VS. 1131 def' red erPct a dam in tirunny couniy, ana was opposea with the contention among others that the ordinance of 1787 established the navigability of the Des Plaines forever." Company I-oc Suit The court held that the river had not been navigable within the mem ory of living men, but the company lost its case, the court ruling that the dam could be built only with permission of the secretary of war. Jacob Shamberg, assistant state's attorney, said there was little doubt the secretary of war could, if he wished, stop dam building anywhere the Des Plaines area.

In 1K82 the Escanaba Steamboat company sued the city of Chicago, arguing that bridges over the Chicago river violated the 1787 ordinance. In this case 107 U. S. 6781 the court ruled that the old ordi- nance provisions could not control the authority of the state after her admission to the Union. The city, a creation of the state, won the suit.
