Fowell, the Democratic leader in the house, has introduced a bill to enlarge the powers of the state auditor which, inadvertently or by design, would have given that officer an unwise extension of authority over the University of Illinois.

The bill also would affect the Southern Illinois university at Car-bondale, and perhaps some other state activities as well. The state university is an institution established by statute and administered by nine elected and two ex-officio trustees. State funds are appropriated to it by the legislature, and any of its "earnings," such as student fees and rents of residence halls, must be deposited in the state treasury and appropriated by the legislature before they can be used. All of the university's transactions now pass thru the state auditor's office. He must approve every voucher drawn, including the pay checks of the faculty and other university employes.

In practice, however, his authority in this respect is limited to determining that money appropriated by the legislature is available to meet the obligation represented by the voucher. The Towell bill expands this authority with the provision that the auditor shall not issue a warrant unless he is satisfied that the amount to be paid is correct and that the obligation has been incurred in with law." This would make the state auditor the judge- of whether the trustees of the university and their agents are proceeding according to law. He must be satisfied of legality. There is not even a provision that the attorney general, the legal officer of the state, shall be consulted. Whether the power of the auditor over the executive departments of the state government should be increased is a matter open to debate.

No good reason has been given for extending his present powers over the University of Illinois. The responsibility for its operation rests in its elected trustees. Its accounting practices are a model for other institutions all over the country, which frequently seek the advice of Lloyd Morey, the veteran university controler.
