Asked today if the county commissioners would investigate the jail situation, Charles E. Miller, president of the county commissioners, said the body had no authority over the jail. "We have no say on the jail," Mr. Miller said. "That's the job for the sheriff.

He's an elected official of the county, and we have no jurisdiction over him." Guard Salaries The county commissioners, however, do allocate funds for jail operation and salaries. Earlier this year, they granted salaries for two additional guards. The prisoner who escaped was one of 30 lodged in the dormitory area. Three guards and one assistant warden, now 80 years old, arrange a schedule to handle the inmates so that at least one man is on duty at all times. Sheriff Norman Howard has complained that the 130-year-old jail, remodeled in 1934, is very much out of date.

Last month, the Howard county grand jury recommended the construction of a "new and modern" jail. Top On List David W. Force, a county commissioner, said today that a jail would "be one of the first" structures to be built if and when the county begins a proposed capital improvement program for county offices. The plan is currently under study by the planning commission. Late last year, the county commissioners pledged an investigation of the jail.

"We did go down there and look it over," said Mr. Force, "and wc promised to help get the sheriff anything he wanted. The result as two new guards. "We also authorized the sheriff to look for a warden. But the salary available is only $2,700 plus room and board.

We hope to find some way of getting more funds. "In the last session, a bill was introduced to put the jail and the guards under the control of the county commissioners. But the bill died, and we never did get a clear explanation as to why." Delegate William S. Hanna, of Ellicott City, said he remembered "us deciding not to push it. But I can't remember why."
