The judge entertained a motion to vacate the fine and continued the case to this morning if the offender in the meantime pays the dog's hospital bill. He had been pursued by Fred Frasano, 1939 Ohio after the dog a pet of the Frasano children, had been struck.

Thompson told the court he saw the animal walk away after the accident and drove off when he became afraid because various members of the Frasano family began yelling at him. M. B. KENNEDY DIES; EXPERT ON CORPORATE LAW Services for Millard B. Kennedy, 58, will be held at 3 p.

m. tomorrow at the First Methodist church in Evanston. Mr. Kennedy, a member of the law firm of Mayer, Meyer, Austrian and Piatt, died Friday in the Banff Springs hotel. Alberta.

His home was at 1130 Lake Shore blvd. Evanston. Mr. Kennedy was an authority on corporate laws, and headed many bar association committees In ad vancing the improvement of various laws. He was attorney for the speak er of the Illinois house from 1934 to 1936.

He also wrote extensively on civil and criminal liabilities. Mr. Kennedy was active with his wife in the Illinois Opera guild, of which she was president. He is survived by his widow, Myrna; a son. Cornelius; his mother, Mrs.

B. Kennedy, Canton, S. a brother, Verne Evanston, and a sister, Mrs. John Odell, Greeley, la. HUSBAND KILLED, WIFE INJURED IN AUTO CRASH Alfred Ridley, 65, of Indianapolis, was killed yesterday and his wife, Anne, 61, seriously injured when their car collided with another car at River rd.

In 19 27 Mr.

Hack was credited with working out the scheme by Frederick C. Hack which the Chicago and North Western railroad was enabled to sell the air rights without selling the land on the north bank of the river between Wells and Franklin where the Merchandise Mart was erected. Used Subdivision Plan The railroad at the time wished to' sell the right to erection of the' building but it did not want to sell, the land on which it wished to retain its tracks, associates of Mr Hack said. Hack worked out a plan whereby the whole tract was converted into a subdivision. The subdivision was then divided into lots.) On such "lots" caissons for the big building were placed and the caisson legally became the "lot" itself; while ownership of the land space! was retained for the railroad Thus, as Hack's associates explained it, the rights to build the rights were sold to Marshall Field Co.

and the railroad kept the land. Mr. Hack was a member of the American. Illinois State, and Chicago Ear associations, and of the Chicago Law institute of which he formerly was president. Served Army as Counsel During World War I.

Before his discharge last September, he was promoted to lieutenant colonel, first Negro dentist to hold this rank.

POLICE GUARD BUSES AS UNION STAYS ON STRIKE New York, July 21 (P) Buses In the borough of Queens moved under police guard today after 500 union drivers for two companies voted to continue their strike which began Saturday.

Police said 300 strikers at tempted to block the movement of the first 37 buses from a terminal of the Green Bus Lines, with a picket line, but dispersed when protective police arrived. By mid-morn ing 53 of a normal 120 buses were in operation, the line said. The strike was called by 800 driv ers and maintenance men, members of the AFL Amalgamated Associa tion of Street, Electric Railway and Motor Coach Employes, against the Green Bus company and the Tri-borough Coach corporation. In voting to continue the strike, the union ignored a plea from Mayor O'Dwyer and union officers to return to work and submit their demands to arbitration. The drivers seek a basic wage of $1.75 an hour to replace the present scale of $1.20 now paid on Green lines and $1.13 paid on Triborough lines.

Vincent's hospital. Her husband, James, survives. Harvey E. Wood Harvey E. Wood, 71, former mayor of Joliet and a member of the loop law firm of Schuyler and Hennessy, died yesterday in St.

Joseph's hospital, Joliet. He was elected mayor in 1913 and for years was a supervisor for the Illinois commerce commission, lie was the father of State Rep. Warren L. Wood Plain-field. Also surviving are the widow and a daughter.

LONDON, July 21 Viscount Lee of Fareham, 78, veteran statesman now best remembered for his gift of the house and estate of Chequers in Buckinghamshire as a country residence for Britain's prime ministers, died today. His widow, Lady Ruth Lee, daughter of J. G. Moore of New York, survives. The title becomes extinct.

CORONER'S JURY FREES GUARD IN FATAL SHOOTING A verdict of justifiable homicide was returned by a coroner's jury yesterday investigating the fatal shooting Saturday night of John La Rocco, 41, of 648 Oakdale av, during a tavern brawl. The coroner's jury exonerated Ed ward F. Brown, 25, of 1252 Columbia av, a watchman who did the shoot ing, when he testified his gun was discharged accidentally as he at tempted to strike La Rocco on the head with it. Brown said La Rocco had followed him to a tavern at 6420 N. Clark from another saloon where La Rocco had called him "a smart alec cop per." He tripped and was pounced upon by La Rocco and the revolver was discharged as they were grap pling with each other.
