Before Judge Morris had. time to defund himself the onlookers interfered and separated them. In the scuffle over the separation Judge Mor- rls' coat was almost torn from his body. This, with the complete demolishment of Judge Walker's umbrella was the most serious damage done, as tha blows struck did not even inflict a wound upon Judge Morris.

Officer Maddox, who arrived on the scene a few moments after the Ifficulty, arrested Judge Walker and carried him to the police station where a charge of fighting was preferred against him. He gave bond for his appearance at the "police court for trial this morning and was released. Judge Morris was not arrested as he had no time to defend himself. When seen by a Statesman re- porter Judge Morris appeared very cool and said: "I am very sorry. in Jeeed that this affair occurred, and I had nothing to do with It, as I was standing peacably on the corner talking to my friends.

It was all so quick and surprising that I had no chance to defend myself before friends interfered. When he brought my official conduct before the grand Jury organized by him with the purpose and expectation of being able to dictate their conduct, I sub-mltted before the forms of the law.

But after the democratic party has decided against him, after the grand jury has decided against him, after the have decided against htmk he con. tinues his malicious and insulting attacks. Under the circumstances I assaulted him and I am restrained from giving him the whipping he has deserved by the fact that he declines to protect himself." ANOTHER VERSION OF IT. One of Judge Walker's friends who saw the encounter made the following statement In regard to it: "The two men saw each other when a distance of 30 to 40 feet apart. Walker made at Morris without a word and struck him a blow over the head with his umbrella, then dropped the umbrella and grabbed him by the right shoulder.

Bystanders interfered and prevented further violence after a struggle. In the matter of the application for the commutation of the death sentence Imposed upon Jim Rivers In the district court of Cherokee county for the murder of Bill Jones, and whose date of execution was set for Friday, the 80th instant, the governor gave the following reasons for commuting the. death sentence to confinement in the penitentiary for his natural life: "There Is no question, whatever, in my mind that the judgment against the applicant is fully sustained by the evidence and that the penalty imposed is none too severe, when considering the crime committed. "The offense has aH the element of willful and premeditated murder.

But it appears that no Issue was made, nor evidence heard, upon the trial of the case, respecting the age of the defendant at the time of the commission of the murder. That question Is now before 'me. "I have carefully -considered all of the statements submitted me, and my mind Is left very much In doubt as to the true age of the applicant. "Article 33, chapter 3, of the Penal Code, provides that: 'A person, for an offense committed before he arrived at the age of seventeen years, shall In no case be punished with death; but may. according to the nature and degree of the offense, be punished by imprisonment for life, or receive any of the other punishments affixed In the code to the offense of which he Is guilty.

Mary's church, has received official notice of his transfer to a wider Held of usefulness, as pastor and superior at Notre Dame, one of the most renowned of American centers of church Influence. While the news of Father Rogers transfer will not come as a surprise, having been rumored for some time past. Its official confirmation will nevertheless occasion both pleasure and piln among the reverend father's many Austin friends. In the church and out of it. His merited promotion occasions pleasure among those who have learned to know him and to admire him as a pastor and as a man during his pastorate here, while his departure will be felt as a personal logs by many who have learned to rely on his kindly counsel and broad human charity and sympathy.
