TALLAHASSEE (UP1)- Treasurer Tom O'Malley formally requested that the proposed appointment of Jay Landers as the state's chief land manager be put on the agenda for cabinet consideration July 2. O'Malley, who forced a delay In Landers' nomination a week ago, alo asked the governor to make sure Landers was at the meeting "to answer questions" he intends to put to htm. Landers Is executive assistant .and chief environmental advisor to Governor Askew who has proposed him to. succeed resigning Internal Improvement fund Trustees director Joel KUperberg. O'Malley disputed the claim of Governor Askew and Attorney General Robert Shevln that the appointment of executive directors, subject to being named by the governor and confirmed by the cabinet, were not agendaed items. He went to the trouble to go back In the records to March 16, 1971, when Kuperberg's Appointment was made. He noted that it was iteh 16 oh the agenda and provided the governor with a copy of that agenda. He also sent along a copy of the minutes showing tha O'Malley seconded the nomination of Kuperberg and approved on a vote of 6-1. The dissenter was Secretary of State Richard Stone. "I realize that your excellency has the power to appoint the executive director," O'Malley said. "It would appear to be that the governor would always want to be consistent in matters of this importance and would properly agenda the item instead of just announcing his intentions." "As a member of the board...I want to exercise my right to have the item agendaed for the next meeging of the board on July 2," he added. TALLAHASSEE (UPI)-The State Suoreme court ordered charges dismissed against four persons who were convicted In Hillsborough County with information obtained by wiretaps. The court said a 1 »YU Hillsborough County grand jury illegally obtained wiretap evidence to press charges against Roland Rodrlquez, Julie Rodriquez, Onelia Cenal and Dahlia Gonzale, who all were convicted of illegally a lottery. The justices voted 3-1 that the operators pf the wiretaps did not follow federal wiretap laws. The decision, said the justices, is not final until time expirees for the state lawyers to file a rehearing petition. "In as much as the convic­ tions of the petitioners were based in substantial part on the improper admission of evidence obtained from the wiretaps in in question, and since we cannot state with sufficient certainty that the admission of this evidence was harmless error, the convictions must be reversed," the court said. The court said the wiretaps recorded conversations which were not in the scope of intent for using the electronic devices. "There was a continuous monitoring of all telephone communications (including those between husband and wife and attorney and client), and that all of the conversations monitored were recorded," the court said.
