Joshua Morgan, in-dieted for the murder of James McGovera. The examination of witnesses on the part of ther State was resumed this morning, the lobby of the Court being filled with a crowd cf persons interested in the trial. Joseph Hamilton, recalled by the State. Saw McGovern on Thanksgiving-day about one o'clock; the day after he was stabbed. Mrs Gorman sworn James McGovern died irt witness' house; he said Morgan stabbed him.

Don't recollect who was present when McGovern mda this declaration. By defence. McGovera boarded with witness. It was the day after he we brought home that her made the statement to witness. George Reilly sworn.

Is a coroner, and held art inquest over the body of McGovern. The jury rendered a verdict that he came to his death from st stab inflicted by the hands of Joshua Morgan. Thei wound was about three inches long, and six inchest deep, directly under the arm between the fifth and. sixth ribs. Did not see McGovern before his death.

The State having closed its examination of witnesses, the defence called the following: George Chapman sworn Was going up street with two or three, and there was a dance in Tyson, street. Asked if they could go in, and were permitted to do so. After awhile heard a fight out poors, and going out saw Braden, Hintonand McGovern; the first two going to fight. The watchmen told them to go off and they did so, going down to Read street. McGovern said he would go down, and when he got there offered to become the second of one of the parties.

McGovern had been drink-ins; Morgan was drunk. They had all been to a. ball. By S-ate. The spree commenced at the house where the ball was held.

Tubman. Thb Cass of Gaines It is said that Mrs. Games commenced the prosecution of her case (which the U. S. Supreme Courtis about to decide against her,) about nineteen years ago, when ehe was Mrs.

Whitney. Subsequently she married Gaines, who espoused her cause as well as her, and devoted his fortune to its promotion. General Gaines expended in the suit the proceeds of two estates which he owned one at Louisville, and the other in Tennessee which he sold for about 100,000. He aise expended his pay and emoluments, amounting to about six thousand dollars a year. Some of Mrs.

Gaines' friends have also advanced considerable sums in her aid, being confident that her title was clear, and would be established. Veteran Patriots. Braden and looking at Morgan knows Morgan was there all the time. McGovern took no part in the fight whatever. George Braden sworn. Was at the dance, and Hinton, Pearce, Morgan and Chapman came in. Hinton sat down in Donnelly's lap, and got up and knocked his hat off.

Hinton then wanted to fight Flsherty. Witness said to him, "Dan, if you want to fight go out of doors, there are ladies in A difficulty arose and they went out in the street, and the watchman separated them. Came from jail this morning and has been there about twelve weeks. Would not say on what charge he was in jail.

Would not say whether he had ever been in the penitentiary. Joseph Hamilton, recalled by State. Knows Daniel Hinton. His general character in the neighborhood where he lives is very bad. The whole neighborhood talks about him, and he is well-known to the poiica department.

By defence. Has known him about four years. He is a drinking, fighting character. Has been told that he would go into a rum mill, get a glass and drink it, and go out without paying for it. Could not say he would not believe him on his oath.

Andrew Wason sworn. Is a police-officer and knows Hinton. He bears a bad character for fighting, getting drunk and kicking up. He goes into people's places, gets liquor and drinks it, and then refusing to pay for it, beats them. By defence Has known him for six yean.

Would not believe him on bis oath. John Fleishell sworn. Has been a police officer. Knows Hinton he bears a very bad character. Would believe him on his oath has no reason to do otherwise.

By defence. Has known him fifteen years. Tobias Airey sworn. Is a police officer, and hast known him ten years. He is no worse than the rest of them rioting end knocking about.

His character is bad. Has never known him to swear false, and would believe him on his oath. A copy of a commitment from Justice King was read by "Mr. Gwinn, which directs the warden of the jail to safe keep Christian Scott, to aEswer a charge of horse stealing. Peter A- Logtie sworn.

Was a police officer, and has known Daniel Hinton six or seven yean. His character is very bad. By defence. It is a pretty hard matter to say whether he would believe Hinton on his oath th odds would be against him. At 12 o'clock the examination of witnesses was closed both by the State and defence.

Mr. Gwinn made his opening before the jury, in which he stated that he should esk the conviotion of Morgan of murder in the fi'st degree. The evidence of his having killed McGovern was most conclusive, in opinion, and be summed up the testimony in a clear, concise and forcible manner, to sustain the verdict he thought the jury should render. The law, as applicable to murder, was read and commented on, and the applicability of the law to the present case, as proven, distinctly set forth. Mr.

Hobbs followed, for the defence, and spoko about an hour and ten minutes, impressing earnestly upon the jury that the facts did not justify a verdict of murder in the first degree, and that, at most, it was only manslaughter, if indeed the testimony of Scott did not show it to be justifiable homicide. He reviewed and thoroughly sifted the whole evidence adduced, and argued the law and authorities which he produced, in a very able manner. He concluded by an eloquent appeal in behalf of the prisoner, who, he said, wssbut 17 or 18 years cf ege, fatherlees and motherless, snd without strong friends to stand forth in his behalf. He thought the jury would coincide with him in the opinion that the prisoner was entitled to an acquittal. Mr.

Gwinn closed the case in a speech of about thirty minutes, refuting the positions assumed by the defence, and in a most conclusive manner setting the facts before the jury, claiming at their hands a verdict of guilty of murder in the first degree. His argument, though brief, was a pattern of eloquence and logic, and was listened to by the large auoience with tne greatest attention. The indictment was handed to the jury at a. quarter cf 3 o'clock, who retired to their room and the couri tooK a recess. The court reassembled at 5 o'clock, and the jury havinet nzreed at half-past five, came into court and rendered a verdict of "Guilty of Murder in the first degree," with a recommendation to mercy.

The jury had neen out two hours ana three- quarters in forming their verdict. The prisoner, Joshua Morgan, was evidently unprepared for such a result, and, when the verdict was announced by the foreman of the jury, his hand, which he held up, dropped insttntaneously to his side, ar.d ha came near fainting. In a few minutes be rallied somewhat and left the dock with tolerably firm step. He is quite a youth not eiehteen years of sge, and said to be an orphan. both parents being dead.
