Frank Kelley have made ag application" to the U.S. Court of Appeals, seeking to overturn a federal court order that Michigan purchase 295 buses for a Detroit area- student desegregation plan. The two officials also said they are asking for an emergency stay of U.S. District Court Judge Stephen Roth's or der June 14 that created an 11-member panel to implement a desegregation plan. Milliken and Kelley made a joint announcement Tuesday, only a day after Roth ordered the state to come up with an $3 million for the buses.

Kelley also said he would file an appeal with the Sixth Circuit Court of Appeals in Cincinnati from both orders by Roth. An appeals court decision could come in "a matter of days," Kelley said. Milliken and Kelley said "The public interest requires the earliest possible determination of our petition for a stay." Roth's order to buy the buses requires the state "to take actions for which there is no tjasis in state law," they said. If the appeals court fails to grant the stay, Kelley said he would take the case to the U.S. Supreme Court.

"The steps we are taking are fashioned in such as way as to achieve a decision before it is necessary for the state to take major actions which conflict with its own laws," the statement said. Roth's order was aimed at implementing an interim desegregation plan this fall involving an estimated 40,000 elementary school children in Detroit and $2 suburban school districts. A full-desegregation plan involving some' 800,000 grade school and high school. students would be in operation in September, 1973. Milliken and Kelley already have filed suit asking the U.S.
