RESOLUTION APPROVING WITHDRAWAL REQUEST; WHEREAS by letter dated March 22, 1972 to the City Manager, Richard Ludwig requested a Special Use Permit to construct a twelve (12) unit luxury apartment complex on property across from Bittner's Texaco Station and Schreiber; Florist on Lake Shore and WHEREAS at the regular meeting of-the City Planning Commission held June 1, 1972, Mr. Ludwig requested that his proposal be withdrawn, and the Planning Commission recommends that the withdrawal request be accepted. THEREFORE RESOLVED that the City Commission hereby accepts Mr, Ludwigs withdrawal for an application for special use permit to construct a twelve (12) unit apartment building on Lake Shore Drive. Mr.

Gast, secondedby Mr. Tobias, moved approval of the, foregoing resolution. Roll call resulted as follows: Yeas: Commissioners Gast, Hanley, Selent, Smith and Tobias. Nays: None. Absent: None.

RESOLUTION APPROVING APPLICATION FOR SPECIALPERMITFOR ELECTRICAL SUBSTATION WHEREAS Indiana Michigan Electric "Company has applied for a special permit to use a triangular piece of land between the Railroad siding and Kerth St. in the City of Joseph for the' construction of an electrical' substation pursuant to Section 80.86 (1) of the Code of Ordinances of the City of St Joseph, and WHEREAS said request was referred to the City Planning Commission be resolution of this Commission adopted May 22, 1972, and WHEREAS the City Planning Commission by letter dated June 2, 1972, recommended that the special permit be granted with the provision that construction drawings be submitted for review by the Planning Commission before construction is begun, and WHEREAS the City Commission is fully advised in the premises THEREFORE RESOLVED that the City Commission hereby approves the request of Indiana Michigan Electric Company, for a special permit to use the above lands for an electrical substation. RESOLVED FURTHER that the City Clerk is 'hereby directed to deliver a certified copy of this resolution to Indiana Michigan Electric Company personally or by first class mail. Mr.

Motion declared carried and resolution adopted. The City Manager read a letter from the State Highway Department refusing to install a Traffic Signal at the intersection of Lake Shore Drive and Wallace Avenue. The Manager stated that the department had previously indicated that a flashing light can be installed in this area and that the cost would be born by the State Highway Department. Mr. Tobias, seconded by Mr.

Hanley, moved that the City Manager request the State Highway Department install a flashing light on LAKE SHORE DRIVE AT KINGSLEY OR WALLACE AVENUE together with a sign reducing the Speed to 25 miles per hour. Roll call resulted as follows: Yeas: Commissioners Gast, Hanley, Selent, Smith and Tobias. Nays: None. Absent: None. Motion declared carried.

Commissioner Tobias deplored the recent desecration of the Doughboy Monument in Lake Front Park. RESOLUTION: BANK DEPOSITORY BE IT RESOLVED THAT pursuant to State Law, the Peoples State Bank be and is hereby designated for the period ending June 30, 1973, as depository in' which the Treasurer of the City of St. Joseph shall deposit all public monies coming into the hands of Buch Treasurer, except for those monies which are required by ordinance to be deposited into other Specified Banks.

WEST TO END BETWEEN WINCHESTER AVENUE AND ARCHER AVENUE WHEREAS, the City Commission on May 15, 1972, declared by resolution that it was a necessary public im-- provement to grade, drain, pave and improve the public alley from South State Street West to end between Win-Chester Avenue and Archer changed to "AN ORDINANCE TO AMEND CHAPTER 80 OF the addition of a new section to be known as Section 80.114 and to read as follows: CHAPTER 80-P ARKING IN YARD 80.114 PARKING IN YARD. No person shall park a vehicle in a front or side yard as defined in this Zoning Ordinance except in a driveway.

It was moved by Mr. Gast, seconded by Mr. Tobias that further- consideration of the Ordinance be postponed until the regular meeting of the Commission to be held Monday; June 12, 1972. Nays: None. Absent: None. Motion declared carried. RESOLUTION RE: COURTHOUSE REALTY CO. WHEREAS, the City of St.

Joseph and Courthouse Realty Company, a Michigan partnership, have on April 19, 1971 entered into an agreement for sale of real estate as therein described; and WHEREAS, it appears that all of the requirements of said Agreement, including those imposed by "Courthouse Square Urban 'Renewal Project, St. Joseph, Michigan, the Urban Renewal Plan R-213," as recorded in the office of the Berrien County Register of Deeds commencing at Liber 206 Miscellaneous at page, 170, and amendments 1 and 2 thereof recorded respectively in Volume 817 at pages 657 and. 658, Berrien County-Records, as required by that Agreement, have been met, except that the nondiscrimination provision in paragraph R-213 (3) (a) (5) thereof is expressly declared in. said Plan-to run in perpetuity (including, but not limited to, the approval of the plans for said project as called for in said Agreement); and WHEREAS, the Courthouse Realty Company has requested the City to record such compliance by Resolution, and to permit the proper officers of the 'City to so certify on the condominium subdivision plan which the Courthouse Realty' Company is preparing; NOW, THEREFORE, BE IT RESOLVED, that the City Commission does hereby confirm that all requirements imposed by said Agreement for the sale of real estate and dated April 19, 1971, and the said Courthouse square Urban Renewal Plan R-213, as amended, have been met, subject only to the future application of the. nondiscrimination clause in paragraph R-213 D(3) (a) (5) of said Urban Renewal Plan, which is declared by the Plan to be perpetual; and BE IT FURTHER RESOLVED, that the Clerk of the City of St.

Joseph be, and hereby is directed to certify such compliance on the condominium subdivision plan of Courthouse Realty Company. Asparagus Harvest Takes Drop When Edward Boone's daily asparagus harvest fell from 140 to 150 pounds down to only 57 pounds Friday, it became matter for the police. Boone fold Benton Harbor state police that each morning he picks the asparagus from the patch he owns jointly with another man off Parte street, Hagar township.

Smith, 26, of 344 High street, on a. charge of assault with intent to commit murder. Officers said Smith walked into the sheriff's department at St. Joseph, to surrender, about an hour after the shooting was reported at 2:08 p.m.. -Police reported that the shooting occurred outside 384 Brunson, apparently after a quarrel.

Police said the hospital reported that Cross underwent surgery to remove some 50 pellets lodged in the right hip and hip socket area. Tlie reported theft of a mink stole; valued at $1,000, was investigated Friday by St. Joseph police. Robert Weiser, told officers the last time she saw the stole was last April, when it was in a hall closet at her home, 2301 South State street Patrick Walsh told sheriff's deputies Friday that two holes had been cut in an above ground swimming pool at his home, 219 Chippewa road, Fairplain. Walsh said his wife discovered the damage when seeing water pouring from the pool.

Beverly Pociask, 20, of 428 Broadway, told Benton Harbor police Friday afternoon that four or five boys jumped from bushes and threw rocks and a broom handle at her, as she was walking on Britain avenue. Irene Ross told Benton Harbor police Friday, that a watch and pistol, totaling $73, were stolen from her home, 601 Edwards. Benton Harbor police Friday evening arrested JoAnn Douglas, 24, of 405 Morton, on a disorderly person charge, after an altercation was reported at Talbot's drugs, 481 Pipestone. Willie Gorman, 13, of 784 Superior, told Benton Harbor police- Friday afternoon that two older boys knocked him down in the 600 block of Clay street, and seized 35 cents. Remedial Courses To Start NEW BUFFALO six-week remedial reading and math program for first, second and, third graders in New Buffalo Area schools will get underway Monday, June 19.

The program, funded by the federal goverment, will be held in the New Buffalo high school cafeteria from 8:30 to 11:30 a.m. A maximum of 36 children may enter the program. THEREFORE RESOLVED that it is a necessary public improvement to install concrete curb and gutter on that part of Lake Shore Drive described as: from the North line of Kull's. Addition to a point 409 feet South of the South line of Vail Court, RESOLVED FURTHER that the expense of such improvement be paid by special assessment to be levied upon the property fronting and abutting upon such improvement and to be levied according to frontage thereon, excepting those portions represented terseetions by street in land public property, if any, which shall be paid by4he City at Large. RESOLVED FURTHER that the several lots, and parcels of land, fronting arid abutting on the concrete curb and gutter to be: installed are hereby designated as the special assessment RESOLVED FURTHER that the City Manager be directed to prepare the plans: and specifications for such improvement together with a statement of the estimated cost thereof and to file the same with the City Clerk for public inspection. RESOLVED FURTHER that upon the filing thereof the City Clerk give notice of the fact that the same are on file in his office and give notice of the time and place when the Commission will be in session to consider said improvement and hear objections thereto; notice shall be given to each owner of or party in interest in the property to be assessed, whose name appears upon the last local tax assessment records, by first class mail addressed to such owner or party at the address shown on the tax records and shall also be published in the St. Joseph Herald Press once at least ten days prior to said hearing.

Nays: None. Absent: None. Motion declared carried. RESOLUTION EXTENDING TIME FOR REZONING THE WALTER HOLTON PROPERTY WHEREAS Walter Holton has requested permission to rezone his property at the corner of Main and Central Streets in the City of St. Joseph, described as Part of lots 7 8, Fyfe's Add.

from two-family to "C-2" restricted office-residence district, and WHEREAS by resolution by the City Commission adopted October 18, 1971, the City Commission tabled the matter at the request of the City Planning Commission, and WHEREAS by resolution adopted November 8, the City Commission postponed further consideration of the proposal until December 2, .1971, and WHEREAS by letter dated December 3, 1971, to L.L Hill, City Manager, the City Planning Commission requested that further consideration of the proposal be postponed for a period of six months, and WHEREAS by resolution adopted December 6, 1971, further consideration of the proposal was postponed until the regular meeting of the City Commission to be held June 12, 1972, and WHEREAS by letter dated May 25, 1972, to the City Manager, in which Mr. Holton has requested a further extension in order to complete his plans for a take out restaurant on bis property, and was published in the St. Joseph terald Press on May 20, 1972, the City Com mission is, now session at said time and place and objections to said public improvement have befeicalled for and no one has appeared and objected thereto and nonob jections thereto have been fill with the City uerx. THEREFORE RESOLVED that it is a necessary public improvement to grade, drain, pave and improve the public alley from South State Street West to End between Winchester Avenue and Archer Avenue, in the City of St. Joseph, Berrien County, Michigan, witli concrete pavement in accordance, with standard alley paving specifications of the City of St.

Joseph. RESOLVED FURTHER that the expense of such public improvement be defrayed by special assessment levied according to frontage upon the several lots and parcels of land fronting and abutting upon the proposed improvement. RESOLVED FURTHER that the proposed special assessment district as defined in said resolution of the City Commission adopted May 15, 1972, be and the same hereby is confirmed and approved as such special assessment district. RESOLVED FURTHER that the plans, plats, diagrams, and detailed estimates of the cost of such public improvement heretofore prepared and filed with the City Clerk be and the same hereby are confirmed and approved. RESOLVED FURTHER that said public improvement be made by and under the supervision of the Department of Public Works and Service.

RESOLVED FURTHER that the estimated cost of said public improvement is the sum of $5278.32, which sum is hereby determined to be the estimated cost of such public-improvement RESOLVED FURTHER that the cost of said public improvement the sum of $301.32 be raised by general taxation upon the City at large to be paid from the appropriate general fund. RESOLVED FURTHER that the sum of $4977.00 be defrayed by special assessment upon all lots and parcels of land fronting and abutting upon the proposed improvement, the same to be levied according to frontage thereon which said lands and premises are hereby designated as the special assessment district for the cost of such improvement. RESOLVED FURTHER that the City Assessor be and hereby is directed to prepare a special assessment roll therefor and to certify the same as required by the City Charter and to file the same in the office of the City Clerk. RESOLVED FURTHER that upon the filing of said special assessment role the City Clerk shall give notice as required by Chapter XII, Section 11, of the City Charter that said roll is on file in his office for public inspection and that the Commission and the Assessor will be in session at the City Hall for the purpose of reviewing said roll and hearing objections thereto at a time and place to be in said notice named, which date shall be not less than ten full days after the date of the publication of said notice; notice shall also be given to each owner or party in interest in the property to be assessed whose name appears upon the last tax assessment records by first class mail addressed to such owner, or party at the address shown on the tax records.
