MERKEL MAKES A STATEMENT Deuics Intention of Harming Auyone Some Damaging Evidence. Medicine Hat, April 28. There a flutter of excitement at the Dreamer trial this morning, when the prisoner, Jacob Merkel, known a the Son of God, asked permission to make a statement. He spoke as follows: "Some two years since I came to Canada. After being here six weeks I went back and told my brothers In Dakota, about the capabilities of the country.

I came back In July, 190, and remained until January, l'JOS, buying; some land and working it. I then went back to Dakota to fetch up horses and machinery. 1 came back In March and since that time have been the land. Otherwise I belong what they call the 'Dreamers," but I continued all my business according the laws of the country. Nothing said at the meeting on April 11 harm anyone.

Nothing was ever raid at any meeting about burning or destroying. I would not approve or up- rtoJd such language. I had no Intention L'f harming anyone, but came to Canada to build up a home as best I could, it Is nineteen years since I came to 'the States from southern Russia. "I married Into the family of After I was married trouble irose. My wife's brothers debauched aer.

They were caught in the act hops than once, but refused to dis continue. Having caught them again got into a scrap. One drew a knife and I had a revolver. 1 was stabbed and then shot him inn the should-. r.

I was sentenced to 80 days and costs. I divorced my wife. This was all done with open eyes. There was no dream. From the evidence In this trial, think the fire was Incendiary.

I know nothing about H. I have read letters In the meetings but there was no mention In them of destroying any one. I gave no orders to destroy. I came to this country to make a success. Coming down to dreams, I have dreams, yes, but I never discussed them with anyone.

I have heard a few dreams talked of at meetings, but I paid no attention and gave no Instructions." Nieman'i Evidence. Fred Nleman's hearing was then resumed. Merkel was called to the witness box. He affirmed that his father was head of the church, with Haufman second and Reib the Canadian leader. Relb was at all meetings.

There had been dreams talked of. Witness was not present when Otto told his dream about Schneider. Jacob Relb had been present when the dreams were told. He was there when Mrs. Gill and Michael Brost related their dreams.

Witness was also present, Lehr was not liked. He was talked of at the meetings. The (Jills were angry over the trials. There was no talk of personally harming him, but the witness bad stated himself that If Lehr had a case against him like the Ollls, he would get even through the law. Carried a Revolver, In regard to threatening that Lehr would go like Magistrate Martin, the witness stated that Lehr made the fame threat about him, and he replied that they would see who would go 11 rut.

Young Neiman was at the meeting on April 11. It was not the Dreamers' belief that those who did not live up to the Bible instructions would be destroyed. The witness' father often sent letters, which were read at the meetings by himself, Neiman and Otto. The trouble was not as bad as It appeared, and there was no necessity to shoot. Witness donled challenging anyone to come out of He acknowledged saying to the Hrosts that If anyone attacked hi in without reason he would empty his revolver Into them.

It was loaded. Ho had also suggested to the Brosts to upnet a load of hay on the bridge, and set fire to it so as to burn the bridge. A new bridge was needed. The witness denied ever having had a letter In his possesion which was written to a Lutheran minister In Java, South Dakota, but Identified a letter from his father asking him to write just such a letter. The letter contained suggestions of a base character.

Constable Ashe was called and testified to finding the letters at Mcrkcl's (Jr.) house. Head of Dreamer Church. Jacob Re ib acknowledged being the head of the Dreamer church In Canada. He had attended all the meetings but two In the last three years. Nothing was ever said In his hearing about dreams, at the meetings or anywhere else.

If Christian GUI and Merkel had sworn that he was present when the dreams were told, he did not remember about It. He could not remember if John Lehr's name had ever been mentioned In meeting. Inspector Parker admonished the witness In regard tJ answering questions In this manner, stating that it looked as though he was hiding something. The witness thon acknowledged that Lehr's name had been discussed In connection with the Gill case. He did not know If he ever had a dream about Christian Gill's sheep, and could not remember If he had ever sent Mrs.

Michael GUI a message that he dreamed she had done it. He had written to Merkel, and Haufman, telling them to come up and answer to the police about their letters of revenge, or the congregation would leave their church. He Wat Evasive. Jacob Reib wasj-ecalled to the witness box yesterday morning and a determined effort made to pin him down to direct statements. After two hours of close examination he admitted that he had received a vision.

He was awake at night when he saw the vis- Ion. His memory then went back -on him again and he could remember nothing more of any vUions which had been revealed to himself or any one else. He refused to give a straight negative or affirmative answer to the question whether there had ever bean any other visions talked about at the meetings or elsewhere. He would not contradict Otto's evidence that iie (Reld) had discussed the dream about Geo. Schnider and the horse trade but simply could not remember It.

Bible Dream. Christian GUI, head of the GUI family, stated that the only kind of dreams talked of at the meetings were those' related to the Bible. He acknowledged that Karl Otto had told of a dream. Jacob Relb had never told of dreams. The evidence given by the witness in the Neiman case was then read to him In which he stated that Reib had toll of dreams.

He then admitted that Relb had spoken of a dream at a meeting in John Bomback's house about thrae years ago. Neither Jacob Merkel, or Fred Nieman had told of dreams. The witness' former evidence was again brought -up against him and the prisoner, by request, warned him against making further misstatements. The witness then stated that he had heard Relb tell of dreaming the first time he had ever seen him. Personally he had never told of dreams.

Lehr's name had often been mentioned in the meetings. The people said he gave him hard treatment. No one spoke of harming Lehr. Merkey, had never written about destroying Lehr's house. When shown Merkel's letter to this ef Discovery" is not so good for acute coughs arising from sudden colds, nor must it be expected to cure consumption in its advanced stages no medicine will do that but for all the obstinate hang-on, or chronic coughs, which, if neglected, or badly treated, lead up to consumption, It la the best medicine that can be taken; It's an insult to your Intelligence for a dealer to endeavor to palm off upon you some nostrum of unknown composition in place of Dr.

ness but not a Dreamer, told of the trouble the Dreamers had caused him; his. two brothers had cut his fence; the prisoner had told htm he would die Uko a bcatst; Fred Nieman had said he would be butchered; his mother had destroyed his entire garden of melons and cucumbers; Kinanuel had threatened to shout him; the Brosts gave him warning of a plot to hang him In Ms own stable when he went to feed his horses at night, he was to be left hanging and others would think It was suicide. Daniel had told him be was to, be killed when caught alone. Threat Against Bomback. John Bomback told of the presence of Relb and other Dreamers at church of which he was a leader.

Relb ssid God had sent him to tell of a vis-Ion. The witness said It was a lie, God did not send him. Dlas said to let him talk anyway and Relb then said that he bad a vision of a bloody woman and that she represented Bomback. The witness then told Relb that hi wanted nothing to do with him as ha knew him In Dakota, and his people shot and burned stables. Later Reib wrote letters threatening to destroy him.

Merkel, and Haufman also wrote similar letters. The witness heard the prisoner tell John Lehr that he would go the same way as W. K. Martin, J.P., who mysteriously disappeared last spring and was supposed to be drowned. Considered Dangerous in Dakota.

Medicine April 28. As an Illustration of the characteristics of the Dreamers, the following letter which haa been received from a former states-attorney In Dakota 1b Interesting: "I prosecuted In Dakota a man named Mower here two years ago for setting fire to a house on Instructions from Jacob Merkel, and David work lor all for wall. THE WINNIPEG TRIBUNE, WEDNESDAY, APRIL 29, 1908. Haufman. Moser while awaiting trial hana-erl himself, after leaving a note claiming he did so on instructions of the people.

But we never got sufficient evidence to try these people on. Later Jacob Merkel shot one Swarta, claiming to do it in self defence. He was tried for attempted murder (Swartx recovered) and the state ac cepted the plea of guilty of simple as sault. Merkel was sentenced to thirty days and $100 fine, which ho paid and then went to CanadH. These people when here were crazy on religion and very dangerous citizens.

Several buildings In their neighborhood were burn ed. Including school houses, without the state being able to obtain any evl dence whatever connecting them with It. but it la generally believed they did it." MONEY LENDER FOUND GUILTY Sarah A. Clegg Convicted of Usury- First Case Under Act -Appealed. The first prosecution under' the Money Lenders' Act was instituted yesterday, when Sarah A.

Clegg, agent for D. H. Tolman, -was brought before Judge Myers, and found guilty of us ury. Sentence was deferred, as K. J.

McMurray, counsel for the accused. satted that the case would be appeal ed. The case, being the first one of Its kind here, has attracted a good deal ot attention, and the final hearing will be watched with interest. It was In stltuted by the attorney-general. The principal witness for the prosecution was Herbert L.

Weiss, an employe of the Saturday Post. vv. H. Hastings appeared for the crown, and E. J.

McMurray for the de fence. The evldonce of Herbert L. Weiss was to the effect that he went to the office of P. H. Tolman and solicited loan of S30.

The defendant Informed mm tnat tne manager was out om that she would look into the request Fhe stated that she could not loan him that sum, his salary not being sufficient. Later lie returned and Informed her of a raise In salary from $10 to per week, rihe then advanced him $35. taking as security an assignment of two months' salary, and blank assignments for two months more. For the loan, witness was to pay back o8 at 12.80 per week for twenty weeks, making the interest on $35 a sum of $21. in about five months.

xHe paid In $5.50 Interest and refused to pay more. Messrs. Hastings and McMurray then addressed the court, the latter endeavoring to show that Tolman had sued for payment of salaries under similar assignments, several times and had won In each case. The Judge. In giving judgment, pointed out that the Interest was much greater than 12 per and under the spirit of the law her business was Illegal.

He therefore found her guilty. A reserve case was refused. CATTLE SALE. List of the Herds Which Will Bo Rep resented.
