Four Devil Rays teammates were suspended one to three games each. Williams was penalized Tuesday for "charging the mound, inciting a bench-clearing incident and returning to the dugout following an ejection," according to the commissioner's office.

Pitchers Dave Eiland, Tony Fiore and Cory Lidle were suspended three games each and fined for "intentionally throwing at batters after a warning had been issued," and Devil Rays manager Larry Rothschild was suspended three games and fined for "failing to pre-empt his players' wrongful conduct and for making inappropriate comments." Frank Robinson, baseball's head of discipline, imposed the penalties after reviewing the Aug. 29 game, interrupted five times by fights andor arguments. Boston's Pedro Martinez pitched a one-hitter, and eight Devil Rays were ejected. The players association appealed the penalties imposed on Williams and Fiore, meaning the suspensions can't start until a hearing before Paul Beeston, baseball's chief operating officer. Lidle started his suspension Tuesday and Rothschild will start his today.

Eiland's suspension was not scheduled to start until later this week and he probably will make a decision today on whether to have the union appeal on his behalf. Williams was ejected for fighting after Martinez hit him on the arm leading off the game and he charged the mound. Boston's Brian Daubach was hit by pitches twice after playing a role in the first fight, during which he suffered a hyperextended elbow. Eiland was ejected in the third inning for hitting Daubach and Nomar Garciaparra. Lidle and Fiore were tossed during Daubach's at-bat in the seventh.

Garvey sued: The Federal Trade Commission is suing Steve Garvey for acting as host of a diet drug advertisement that federal regulators contend was deceptive. The suit alleges Enforma Natural Products Inc. made "false and unsubstantiated" claims about "The Enforma System." The company claimed in TV and Internet ads that users could lose weight without dieting or exercise, regardless of how much they ate. One of the other players was named as a suspect, but Hamo dropped the charges and the case was never resolved. Ellerbe found out about this latest incident from the players Monday afternoon, while the coach and his wife, Ingrid, were preparing a welcome-back barbecue for the team. The barbecue was canceled. The players had been held in jail overnight after their arrests at 3:15 a.m. Monday.

Fall classes start today. According to a copy of the police report obtained by the Free Press, Taylor police officers noticed a 1990 Ford Tempo traveling south on Telegraph near Warwick Road. The officers watched as the car stopped in the right lane, and three people got out and began wrestling. The car belongs to another freshman, Josh Moore, who was not in the car at the time. "All three were behind the car and in the roadway; they were engaged in horseplay," Taylor police chief Thomas Bonner said.

"Several cars had to change lanes to avoid hitting these guys." Gaines, Robinson and Queen all are 19 and all had been drinking, the report said. The report said officers stopped and shouted at the players. "We had to repeatedly give loud verbal commands for them to return to their vehicles," the report said. The three complied about 35 seconds after police arrived. The report gave no further details about the horseplay, and Bonner said he did not have an explanation from the officers who did the report.

Gaines told police the trio had been coming from a fraternity party. "Maybe they were lost or turned around," Bonner said. Gaines had a .17 percent alcohol level, according to a breath test. By Michigan law, anything .10 or higher is considered drunken driving. Police also tested Queen, who registered .16 percent, and Robinson, who came in at .09 percent.

The players were released Monday afternoon to U-M Public Safety officers, Bonner said. No one has been charged, and Bonner said he expected a decision on charges today. Gaines, from Las Vegas, may be charged with drunken driving, he said. Queen, from Moreno Valley, and Robinson, from Washington, D.C., could face charges of minors in possession of alcohol. All the charges are misdemeanors, Bonner said.

Ellerbe said his concern now was for Gaines, who will be allowed to- keep his scholarship and stay in school if he chooses. Ellerbe said Gaines' U-M career definitely was over. That means only two players remain from last year's ballyhooed recruiting class: La Veil Blanchard and Gavin Groninger. Jamal Crawford left for the NBA, and Leland Anderson has transferred to Providence. Gaines is free to transfer but must sit out a year before playing again.

"He's been granted his release if he wants to use it," Ellerbe said. "The bottom line is we want him to be OK Basketball is really a moot point right now." The dismissal and arrests are the latest problems for the troubled U-M program, which has been tainted by player incidents and a federal investigation of banned U-M booster Ed Martin for alleged gambling activity at Detroit area auto plants. There is no allegation of gambling involving U-M basketball, but at least two former players have told a grand jury Martin lent them large sums of money. Last year, Queen was charged with assault after he and another student at a Massachusetts prep school hit a fellow student with a belt. Under a plea agreement in June, Queen will receive a year's probation and serve 50 hours of community service.
