2B The Detroit News Sunday, June 18, 2000 State Supreme Court race shaping up as a nasty battle GEORGE WEEKS I Helmet b.vs Nearly every state required motorcyclists to wear helmets by the early 1970s. But after Illinois repealed its law in 1970,, other states changed theirs. This is the status now; Illinois, Colorado and Iowa don't require any helmets. 22 states, Including Michigan, require all motorcyclists to be helmeted. 25 states don't require adults 21 and older to wear helmets; in many cases, only those 17 years or younger have to wear HELMET Continued from Page iB But state police Insist the law is enforceable.

"If you want to know which helmets are approved. It's the ones approved by the (US.) Department of Transportation," Sgt Thad Peterson of the state police said. "We do have rules." A circuit court in Hastings is the highest court to hear an appeal so far. It upheld a district court decision to dismiss a ticket. The state Court of Appeals and Supreme Court haven't ruled on the issue.

There is so much confusion right now," said Judge William Crouchman of 40th District Court in St Clair Shores. "It isn't right to have such a wide variation." Crouchman upheld a ticket in hopes It would be appealed so a higher court would rule. For some motorcyclists, challenging the helmet law is about freedom of choice. Michigan is one of 22 states that require helmets for all riders. Some others require them for young riders.

For law enforcers, doctors, insurers and other safety advocates, the only issue is protecting riders and the public against the physical and financial risks of going bareheaded. "When helmet laws have been repealed or weakened, it has been followed by an increase in the fatalities," said Stephen Oesch, spokesman for the Insurance Institute for Highway Safety, based in Arlington, Va. "Motorcycle laws are common sense. You are extremely vulnerable to serious Injuries and death on a motorcycle." Source: Insurance Institute (or Highway Safety AS a 1960s University of Detroit outfielder, Thomas Fitzgerald won All-District honors and helped win three championships. But.

he says, "I couldn't hit a curve ball." his next contest, he'd better be wary of the bean ball, because he's entering a nasty field of battle. Fitzgerald, a member of the state Court of Appeals from Owosso, has been selected by managers of the Michigan Democratic Party as Its third combatant for the three Michigan Supreme Court seats that will be decided by voters on Nov. 7. A formal announcement could come this week orpext. Dem strategists have not made final decisions on slot-tings, he noted the party buzz has been on these matchups with Republican incumbents: Fitzgerald vs.

Justice Steve Markman; Wayne Circuit Judge Edward Thomas vs. Justice Robert Young; and Detroit attorney Marietta Robinson vs. Justice Clifford Taylor. Fitzgerald, 60, has served on the appeals court with the three justices. He considers Taylor a good friend.

Whatever the six contenders think of each other personally, it will be a mean, bruising battle. It will be inflamed by multimillion-dollar ad campaigns by Republicans and their businessinsurance allies, and Democrats and their labortrial Jawyer allies. In a Friday phone chat with Fitzgerald, from his summer home in campaign money to fund it. Despite protests, each site hums along in new age campaigning. These days, candidates like to get hits.

Ecology wars Spurred by enthusiasm generated at last week's "Environmental Summit" in Traverse City, the Michigan League of Conservation voters is accelerating efforts to raise $00,000 to help elect pro-environment state representatives. Heading the effort is Cindy Janecke, who said the league will rate candidates in all races but concentrate its money in just a few. She said Macomb County, the Ann Arbor area and northern Michigan are among possible areas of focus. Meanwhile, the league is developing voting record rankings on all incumbents seeking re-election, and will seek views from challengers, in preparation for making endorsements across the state. Don Inman, ex-deputy director of the Department of Natural Resources, applauds the effort but says that so far, environmentalists have been about as effective politically as someone "shooting BB guns at a tank." George Weeks is The News' political columnist.

His Sunday column appears in the Metro section; his Tuesday and Thursday columns appear on the Opinion page. Write him at 209 N. Seymour, Lansing, Mi, 4S933- Harbor Springs, he said "probably the hardest part of this process will be raising money." Q. Won't you have big help? A. You bet I will.

There will be huge help. Cyber wars US. Sen. Spencer Abraham, R-Auburn Hills, has been getting publicity out of his sprightly Web site that attacks his Democratic challenger, US. Rep.

Debbie Stabenow of Lansing. Abraham's campaign relished the attention the site got when the Tennessee firm that sells Little Debbie snack cakes protested that Abraham uses a logo too similar to that of dessert Debbie. The flap quadrupled the number of hits, or visits, to Abraham's site. Now comes the Michigan Democratic Party with DollarsandSpence.net, a clever site attacking Abraham for what party chairman Mark Brewer says is "a consistent pattern of voting to benefit his major campaign contributors." Abraham's camp, which denied any quid pro quo, protested that it is "a lame copycat Web site" and that Stabenow should be using her own FLETCHER Continued from Page iB So far none has stuck, but jail documents indicate Fletcher has used lofty legal principles in his quest to better clean his clothes, go outside for exercise, bring the books to court, refuse to answer deputies' questions and gain access to even more forms to file grievances. A 1997 graduate of University of Detroit Mercy Law School Fletcher practiced law for about 'years before his arrest for the Aug.

16 shooting of his 29-year-old wife, Leann, in their Hazel Park home. Prosecutors contend the 30-year-old shot his wife after they had sex because his wife's pregnancy jeopardized his affair with Warren District Judge Susan ChrzanowskL Attorney Brian Legghio, whose defense begins this week, argues Leann Fletcher accidentally or purposefully shot herself while trying to change a clip to a pistoL Fletcher mostly handled drunken-driving and similar cases during his brief career, but he's already invoked the Fifth Amendment rights against self-incrimination, and the First Amendment's separation of church and state clause in his feud with the jail His biggest beef is that he can't go outside to exercise. Jail policy allows inmates one hour a week so long as it's at least 65 degrees and isn't raining, McCabe said In a May 19 suit filed in US. District Court in Detroit, Fletcher complained he's only been outside for an hour total since his incarceration and demands an hour a day, five days a week. McCabe said the inmate has turned down 16 offers to exercise in the gym.

Other complaints include deputies' refusal to allow Fletcher to bring a noh-religious book to a December court hearing fashion a clothes line out of a sheet; acquire more than one grievance form at a time; and stand mute when deputies attempted to resolve a complaint without a formal form, as is jail policy. Deputies' insistence on asking him questions prompted a March letter state Corrections Director Bill Marda Fletcher asserted his "right to silence is absolute" and took guards to task for "grievous" and "illegal" behavior, the letter stated. Most of the grievances invoke legal principles. In at least one, Fletcher just doesn't like a guard's attitude During a January dispute about his improvised clothes line, the lawyer took a deputy to task for responding with a "two-tone grunt" and another "simian gesture" when he asked questions about preventing fmold, mildew and various forms of bacteria," the grievance stated. 1 Death Notices Funerali, Service) ss Today ELSEY KIEFER SCHROER W.
