That is the effect of a Michigan Supreme Court decision Tuesday which upheld the right of a gunshot victim to sue three hunters even though the victim already had declared which of the three allegedly shot him. The 5-3 decision reversed that portion of a Kalamazoo County Circuit Court decision which had dismissed the joint liability suit. Robert McCoy charged in a 1960 suit that three pheasant hunters fired a shotgun in a corn field "negligently, carelessly and recklessly," injuring him. In a deposition, McCoy said he was positive which of the three had shot him. Neverthless, he sued each separately, and all three jointly in a fourth count of the suit. The Kalamazoo court had thrown out all suits except that against the hunter McCoy said shot him. The supreme court's five Democrats ruled, however, that even admission of which defendant did the shooting "in itself would not necessarily absolve the other defendants from liability." The opinion said McCoy could sue jointly since he maintains "that all three defendants were jointly engaged, negligently, in a concerted activity as a result of which plaintiff was injured." It said such suit could proceed even if no violation of law were found. Whether the three hunters were jointly liable will depend, of "course, on results of the suit itself. "They're free to export so far as we're concerned," said Canadian Fisheries officer Maurice Houghton in Vancouver, B.C., "We have export regulations covering salmon but - " The 22-foot whale has been purchased by Seattle aquarium operator Ted Griffin, who paid $8,000 to the two fishermen who netted him at Namu, B C. A 49- by 60-foot pen was built for Namu at Namu and the whale, pen and all, is being towed the 400 miles to Seattle The trip is expected to take another week because the tug, the powerful Iver Foss of Tacoma, Wash., is making only threa knots, it can go faster, but Namu can't. Community College Will Open in 1966 MONROE (AP)—Trustees of Monroe County Community College decided Monday to begin a limited program of Instruction in September, 1966, using facilities of area high schools Some buildings are expected to be completed by September, 1967.
