The recent indictments of former Senior Sgt. Byron "Bubba" Cates, the vice squad's former supervisor, are symptoms of the problem with enforcement of "sin laws," such as those against prostitution, said Nancy Moses of Citizens Advocating Police Reallocation. She was joined at a news confer ence by Terry Liberty Parker of Texas Freedom Network and representatives of four other groups. While not all police officers are bad, "unfortunately, they're just trying to do the job in a system of government that has come to be the complete opposite of what it was intended to be that is, the government that governs best governs least," Moses said.

Mark Tesauro of the University Libertarian Group said, "It seems a bit ludicrous" that police should spend nearly $360,000 a year on its vice squad as gang violence escalates in Austin. The coalition must initiate conversations with police Chief Jim Everett about the vice squad and beatings by police, said Sylvia Ce-dillo of the Central Texas chapter of the American Civil Liberties Union. She said the chapter averages 50 calls a week from citizens saying they have been humiliated or beaten by police. "It's embarrassing that a city like Austin that considers itself progressive will tolerate (it)," she said. Capt.

Bruce Mills, who oversees the vice squad, said the division was created in response to complaints about prostitutes, mostly in South Austin. "It was the judgment of the grand jury that there had been unlawful destruction of property," Oden said, "and they felt strongly that the public, as a matter of principle, shouldn't pay" for the damage.

Phillips Brooks American-Statesman Staff Although the old jail atop the Travis County Courthouse has been empty for more than two months, the final blow was delivered Tuesday. Sheriff Doyne Bailey handed out metal plaques fashioned with crusted locks cut from cell doors and requested that the old jail be "put on vacation." Commissioners are scheduled today to approve Bailey's request and to take action to end a federal lawsuit that has overshadowed the jail since it was filed in 1972. "We couldn't be more delighted and proud of our sheriffs department for working through the process of closing out the jail," said County Judge Bill Aleshire. In the coming weeks county attorneys will seek to have the lawsuit dropped because it is no longer relevant, Aleshire said. The old jail was declared unconstitutional in 1974 and ordered closed by December 1990.

The closing was complicated by litigation last year, when state officials were added to the suit. Lawyers representing county commissioners complained that a growing backlog of felons awaiting transfer to state facilities was causing crowding and financial problems for county jails. No prisoners have been housed in the lockup since April 6. If the county runs out of jail space to house convicted felons during peak summer months, it will pay other counties to hold its prisoners, Bailey said. That procedure is provided for in the budget, he said.
