Firemen said Iiams apparently died of smoke inhalation after fire broke out in his fourth floor room at the Quality Inn Motel, W. Fifth and Jefferson streets. Firemen theorized that Iiams had fallen asleep while smoking in bed, was roused by the smell of smoke and tried to crawl from the room but couldn't find the door. THE VICTIM was found lying under a table. Firemen attempted to revive him but he was pronounced dead "on arrival at Schoitz Memorial Hospital.

Mossman, 56, an area veterinarian, who died Monday morning of a heart condition at Allen Memorial Hospital in Waterloo are tentatively set for 1:30 p.m. Wednesday at the Trinity United Methodist Church in Dysart; burial in the Dysart Cemetery; survivors include his wife, Violet; a son, James of Cedar Falls; his father, Dennis of Waterloo; a sister, Mrs.

DORA YOUNG A Waterloo judge Monday dismissed six obscenity charges filed nearly 16 months ago after police raided a showing of the controversial triple-X movie "Deep Throat." District Associate Judge.

Edward F. Kolker said he dismissed the charges against the former managers of the Midway Cinema Theater, 4016 University on an oral request from the Black Hawk County Attorney's office. In asking for the dismissal, the county attorney's office cited recent state Supreme Court rulings contending that applicable Iowa obscenity laws were unconstitutionally vague. Judge Kolker in his ruling also ordered Waterloo police to release the two-reel film to the American Amusement Co. of Dubuque.

JUDGE KOLKER'S ruling Monday ends extensive court manuevering that followed the raid in March 1973 in which the then managers Mr, and Mrs. Raymond Garcia were arrested and the sexually explicit, 61-minute movie was seized, The Garcias were subsequently booked on charges of providing immoral plays, exhibitions and entertainment, providing articles for immoral use and advertising obscene movies. The case in its early stages involved numerous court bat tles but had lain dormant since October when defense attorney Patrick Life of Os-kaloosa asked for a continuance until a decision on another suit involving "Deep Throat" could be reached. That suit, filed by County Attorney David Dutton asked that another Waterloo theatre that was showing the movie be closed on the grounds the movie violated Iowa laws concerning lewd conduct. DISTRICT JUDGE Peter Van Metre however dis-smissed that case against the Mini Cinema 16 located at 624 Commercial contending that the section of the law dealing with lewdness did not apply to motion pictures.

The State Supreme Court later ruled that most Iowa obscenity laws were unconstitutionally vague and un-enforcable. In addition, the U.S. Supreme Court had last year handed down a ruling saying local community standards rather than national standards should be used in determining whether materials are obscene. The ruling, in effect, put the burden on local communities to establish their own obscenity ordinances. The Waterloo city attorney's office has been working on a city obscenity ordinance for several months but a draft has not yet been completed.

man dies in crash WAUKON (CNS)-David H. Wikan, 18, of rural Decorah, died of injuries received in an accident in a milk truck Saturday afternoon one and a half miles southeast of Waukon. David, the son of Mr. and Mrs. John Wikan was pronounced dead on arrival at Veteran's Memorial Hospital in Waukon.

Charles Berg, 23, of rural Postville was driving a milk truck north on Highway 76 about 6:30 p.m. Saturday when he lost control on a curve. He was taken to Veteran's Hospital in Waukon where he was treated and released. The truck hurled across the highway into an adjacent ditch and overturned twice. Wikan, a passenger in the truck, suffered massjve injuries when the truck rolled over on him.

Berg was charged with operating a motor vehicle while intoxicated, failure to have control of his vehicle and operating the truck without a chauffeur's license. The milk truck, owned by Ludlow Creamery of Waukon, was a total loss. It was valued at $6,000. The accident was investigated by the Allamakee County Sheriffs office and the Iowa Highway Patrol. Funeral services for Mr.

Wikan's maternal grandmother, Mrs. Alvina Klotzbach were held Monday. Funeral services for Mr. Wikan will be 10 a.m. Tuesday at the Decorah Lutheran Church.

Burial will be in the Lutheran Cemetery. His survivors include his parents, and Mrs. John Wikan of Decorah; three brothers, Ronald of Monona, William of Philadelphia, and Edwin of Waukon; three sisters, Charlene of Waukon, Mrs. Dale Jones of Monona, and Mrs. Dennis Ruffridge of Decorah.

The Steine Funeral Home in Decorah is in charge of arrangements. Resurfacing is slated on West Fourth Resurfacing work will begin. Tuesday on a two-mile stretch of West Fourth Street and is expected to affect traffic flow through Friday. According to a statement issued by the city engineer's department, temporary detours will be in effect as posted and parking will be prohibited at times during the project. The resurfacing project will affect the stretch of W.

Fourth Street between Washington Street and Ansborough Avenue. Motorists encouraged to use alternate routes. Dust blamed for Mitchell crash; 3 hurt OSAGE (CNS)-Dusty road conditions caused a headon collision in which three persons were injured near Osage Friday night. According to authorities Rickie Fenton, 24, of Orchard was following a- car being driven by his wife on a gravel road seven miles east and a quarter of a mile south of Osage about 5:30 p.m. A car driven by Emil Nemeth, 63, of St.

Ansgar was approaching from the opposite direction. Due to dusty conditions he pulled off to the side of the road. After the first car had passed, Nemeth pulled onto the road and collided with the car driven by Fenton. Fenton was listed in satisfactory condition at the Osage hospital with chest injuries and for the removal of a door handle which was lodged in his thigh. Nemath was held for observation and was listed in satisfactory condition.

Mark Dunley, 15, a passenger in the Nemath car was treated for shoulder injuries and received X-rays and was later released. Sheriff Richard E. Jahnel said both vehicles were a total loss and no charges would be filed. Airman grad NEW HAMPTON (CNS)-Airman William F. Glaser, son of Mr.

and Mrs. Francis Glaser of New Hampton, has graduated at Sheppard AFB, from the U.S. Air Force communications specialist course. He has been assigned to Offutt AFB, for duty. Supervisors ok computer unit who reported that smoke was coming from the motel's ventilating system.

When firemen arrived, how-ever, they found dense smoke in a fourth floor hallway and traced its origin to Iiam's room. The mattress and box spring were destroyed In the blaze but there was only slight damage to the motel, fire officials said. MR. IIAMS was born May 27, 1922, in Madison County the son of Henry and Alice Muck Iiams. He was married to Eva Rose Fielker Sept.

24, 1945, in Troy, and they were later divorced. Mr. Iiams was employed at Rath Packing Co. for 22 years, retiring in 1972 because of a disability. Survivors include his parents of Cedar Rapids; a son, David of Racine, three daughters, Mrs.

Jerry Jordan of 1616 Schreiber Cedar Falls, Mrs. Craig Martins, 1300 Bertch and Marcie Iiams of 1907 Randolph two brothers, Vernon of 1307 Bertch and Russell of Cedar Rapids; three sisters, Mrs. Evelyn Crenshaw of Lorimor, Mrs. Mary Kalianoff of Des Moines, and Mrs. Doris Wad-dell of Stuart.

Friends may call at the funeral home after 7 p.m. Monday. JOSEPH R. NELSON CEDAR FALLS-Services are pending at Dahl-Vanllove-Schoof Funeral Home for Joseph R. Nelson, 72, of Lawn City Nursing Home.

He died at 7:20 p.m. Sunday at the nursing home. HARVEY W. HARTWELL Funeral services for Harvey W. (Harry) Hartwell, 63, of 1018 Wellington who died at his home Monday morning of a heart attack, are pending at Locke Funeral Home.

He was born on March 2, 1911, in Minneapolis, the son of Orville and Grace Hartwell. He was married to Feme White on July 14, 1937, in Washington, D.C. He was employed as a supervisor at John Deere Waterloo Tractor Works. He is survived by his wife at home and a brother, Orville Hartwell, of Minneapolis, Minn. Friends may call after 2 p.m.

Tuesday at the funeral home. MRS. ROSS HABENICHT Services are pending at Parrot and Wood Funeral Home for Anna Habenicht, 76, of 1704 Burton Ave. She died at 9 a.m. Monday at Windsor Care Center, Cedar Falls.

Freinds may call at at the funeral home after noon on Tuesday. EVERELL P. OLSON CEDAR FALLS-Services for Everell P. Olson, 47, of 2308 Center will be at 1 p.m. Tuesday at Chapel of Memories West in Waterloo with burial in Greenwood Cemetery.

He died at 7 a.m. Saturday at Schoitz Memorial Hospital. Friends may call at the funeral home after 5 p.m. Monday and until service time. Sheriff receives warrant in murder-for-hire plot $1,385.22 owed for taxes in 1970 and 1971.

The settlement was determined in bankruptcy proceedings. THE BOARD approved a payment of $246.75 to Dike Turkey Ranch for 141 turkeys killed by dogs and a payment of $55 to Leroy Rousselow for 50 pullets killed by dogs. Mon The Black Hawk County Board of Supervisors Monday approved an agreement submitted by Manpower Planning director Gordon Mallett for computer services to be provided by the county data-processing unit. Cost of the computer service is to be $2,200 per year and will come out of the Manpower grant of $608,000. Mallett said the computers will be used for the allowance payments for Manpower trainees. MALLETT ALSO told the supervisors that the number of applicants for the position of Manpower director has been narrowed to six. Originally 38 persons applied for the job.

Mallett is due to quit his position in late August to go to school in Michigan. The supervisors approved a compromise tax payment for Chappies Sport Center, which had formerly done business as Quarterback Sports and Leisure, in the College Square Shopping Center in Cedar Falls. The supervisors accepted $789.78 as a compromise for JOSEPH O. EILER CEDAR FALLS-Services for Joseph O. Eiler, 75, of 807 First will be at 10 a.m.

Wednesday at Dahl-VanHove-Schoof Funeral Home, with burial in Fairview Cemetery. Mr. Eiler died at 5:15 p.m. Sunday at Schoitz Memorial Hospital, Waterloo, of cancer. Mr.

Eiler was born Aug. 20, 1898, at Sioux Rapids, the son Black Hawk County Sheriffs authorities said Monday they have received a warrant for a Nevada man wanted in connection with a murder-for-hire plot against the wife of a former Cedar Falls resident, Gail G. Bon-neson, 49. Larry Kittrell, purchasing agent for a Bonneson-owned gaming equipment firm in Nevada, is being sought on a Nevada warrant charging conspiracy to commit capital murder. Kittrell allegedly paid a "hit man" $5,200 to murder Bonneson's estranged wife, Camie, 29, who is living in Las Vegas, according to Las Vegas officers.

Geoffrey Grimes, representing Stenson and Warm, architects, said problems with a northeast wall of the building will have to be reevaluated with architects and contractors before the board's next meeting. The wall is reportedly out of plumb. In addition, the brick facing of the building has been found to be porous, allowing water to leak into the upper floors of the structure.

Architects and contractors will present their recommendations to the committee before the board's next meeting, at 7:30 p.m. July 23 in the board room of the Administration Building. HIT'S RECENTLY completed high school buildings and trades house at 2715 Alameda Cedar Falls, will be advertised for sale. Board secretary Allan said before the house can be sold a problem must be resolved with a neighbor whose dirt retaining wall reportedly touches on the HIT property. The board will also retain its former maximum balance figure of $2 million per bank. The approved budget must be filed with the Black Hawk County Auditor by Aug. 15. AFTER ADJORNMENT of the board, the Buildings and Sites Committee heard a progress report on HIT'S new Technical Arts Building. Some HIT departments began moving into the building last month.
