Barnard, prosecuting attorney of this county, has appealed to the Supreme Court. The question involved whether the blank applications on which druggist are permitted, under the Beardaley law, to sell liquor by the quart, are private papers or public records. If the Supreme Court holds that they are private papers, and not subject to scrutiny by the officers of the law, then the druggists of the State an -sell whisky, and that, too, without a license. The history' of the case appealed by Mr.

Barnard is Interesting from every angle, for it Involves many question and the curbing of whisky selling by druggists depends on the outcome Of the appeal. Newcastle, by remonstrance, got rid of the and the report was that the blind tigers opened up business at once, and that some of the drug store tn Henry county sold more whisky than the saloon ever did. Prosecutor Barnard brought before the grand Jury "all the druggist of. Henry county and ordered them to bring in: these applicationK. Barnard called the attention of Judge Jackson- to refusal of certain deuggists either- to bring in the applications or give testimony. Judge Jackson, after reading a transcript of the questions asked in grand jury room. -ruled that it wan legal evidence' and such -that the grand "Jury was entitled to. The defendants still refused -to produce the application and answer questions, and at the order of the foreman of the grand Jury each was taken' before Judge Jackson by the sheriff and the court gave each one hour to. answer or be punished lor contempt.
