Union Pacific Railroad Company. The alternative writ of mandamus awarded at the last term waa served upon the President and General Superintendent of the company at Council Bluffs, in this district. The company made a special appearance, and excepted to the sufficiency of this decree, and moved to quash the same. In overruling lhesa exceptions, Dillon. C'rcuit Judge, in orally delivering the judgment of the conn.

In substance says: "ThU is a proceeding Instituted by certain persona residing iu Council Binds, in this Ptate. who claim that the; are aggrieved by reason of an alleced iai l- ureot the Union rauiuc Kaliroad Company to operate la road according to law. The fifteenth section of the 1461, which was an act amending the original charter of thti company, citing It additional subsidies and additional grants of land, by meant of which in reality the road wa subsequently constructed, provided that It should be the duty of the company to operate la road, to far at tht government and the public were concerned, at one continuous line. In thtt cate it it alleged that the company refusal to operate their road at a eoniinuons Hoe: thai in (act they operate it at one oouttnuout line at far only at the city of Omaha, and there break lta continuity by the aeucy of a distinct and separate transfer from that point to the Iowa tide. Court Ui.) In l7i Congress pasted an act in these words Toe proper Circuit Court of the I ted States shall have jurisdiction In hear and determine ail cases ot mandamut to compel the said I'nton Pacific Railroad Company to operate ill road as required by This was an act which was Indispensable in order to give tnis court original jurisdiction in mandamut. and wat peaa.l for that (2 Dillon, 227). Tbis proceeding tore to-fur eame before us on two cues lions. Ths oue was: Whether private persons could record for Um writ: that la, ceuld institute these proceedings to compel the road to perform It public duty, or whether the pruLeding mutt not be insuiutea or tne Attorney i.eoerai. i nave ae- clded, at tht last term, that the writ wat well moved that if private persons eon I snow mat tney were interrttea In the operation of the road, they had a right to come into court under thii act and call It to account for failing to perform iu pub lic duty to their imury.

and thereupon awarded the alter native unit, tin tne other auettlon. whether the circnit Court of the District of Iowa wat the proper circuit court' before which to bring this proceeding, we give no opinion. The act of June, 1874, makes an addition to the fifteenth section of the act of July. 1864: provides that there shall be added to it the following words: 'Any officer or agent of ths compauy who it authorized to construct the aforesaid road, or of any company engaged in op erating either of said roads, who shall refuse to operate and use the road or telegraph lines under hit control, or which he engaged in operating, for purposes of com municalion. travel, and transportation, so far as tht public and the government are concerned, at one continuous Use, and without discrimination of auy kind, shall be deemed guilty of a misdemeanor, and on conviction thereof shall be nnea ana impruouea.

inn act Biasea 11 the personal duty of the officers of the road to operate it at one continuous Hue. Now, if it can be showu that the President of the road it not operating it at a ooutinuout line, within the meaning of this act of Congress, then he 11 guilty and may be punished, and I do not think for the violation of the act In this respect he can be protected in any resolution of the Board of Inieetora. The law says: You shall operate thit road on one continuous and enjoint thit duty upon the officers of the road. In the next sentence tht phraseology charges: In ease of failure or refusal at tne cnion racinc Katiroad, or either of said branches, to comply with the requirements of thit act, and the act to which this is amendatory, an action against them may be brought in the District er Circuit Court of the United Statev in the county, district, or circuit in which the road or any portion of it may be situated, for damages on account of such failure or refusal. The action must be brought in the court of tome district in which tome portion of the road of the defendants Is situated.

It Is of course to be regretted that the phraseology of the act it not to clear at to admit of no controversy: and yet, wben ws consider that it it our duty to carry out the intention of Congress to far as we can learn it, it does seem to us that it admits of very little doubt tbst this Is upon the assumptions above The writ of man dam tit, in May, goes to the corporation, to the corporate body, and commands it to perform Its duty (granting that any pert of the toad it in thit dittrict), and il this writ, thus commanding this duty, it served upon the chief otBcer of the corporation, its President, or upon any officer who may be Indicted and criminally punished. if thav fail to do their duly In thit resnect. then it see ma to ut tbe court bss jurisdictloit over the company and Iu mandamus to compel ths performance of this nt may, pernaps, run alto under ths set To the President of the Company.
