The Southern Family Journal, of Florida, says that a most deliberate and cold blooded murder was commit ted on the 2lst ult at Greenville, C. in that State, upon the person of a young man natiud Robert Headdn, by Mr Dexter Wells. The weapon used by Mr. Wells was a double barrel gun. He discharged both the barrels the contents of which Headden received in his right and left side nine in the right and nine in the left side numbering, altogether, eighteen bullets.

Mcl'ABE, concerned, nor one in vfhich the rights and pri vilcges of the entire press are alone involved; it a question of vital importance to every individual, for there is ne man in our city who has expressed or endorsed the views contained in the article excepted to by the court, but, if one of his fellow citizens chose to communicate the fact to the attorney general, he would be bound by his oath to cause a similar writ to issue against the offender, otherwise that officer has acted most tyrannically and unjustly towards us. This is a plain proposition and may be understood by all men; our readersarc, therefore, well aware how far they are committed, and to what extent this marvellous power would be exerted, if every individual approving the sentiments contained in the publication in reference, should be dealt by equitably with ourselves.

It will be seen at once, therefore, that such a power is utterly at variance with our political character, for we are satisfied that if the principle were carried out by the court, the court would be in a most ludicrous minority. Indeed, it would af-iord an exhibition of the old sedition laws in their most objectionable characteristics, so broadly extended as toembiace an entire community, and thus to annul their own power. The power to punish "contempt of couit" existed long before newspapers did, and, therefore, newspapers are only secondary to men in what may be deemed verbal contempt. They are, however, more tangible witnesses against the offender, inasmuch as they bear always the same unvarying testimony, and therefore more readily visited with this summary authority. Hence the adherents of those antique and obsolete principles of arbitrary power, which have been long subject to the decadent influences of an enlightened age, love to indulge a propensity for the xercise thereof, even by the violence of construction, at the expense of a liberal press and why? Because, such a press has been from the earliest period of typographical art, the fruitful source of those very elements which constitute the basis of all liberty, equality and social independence; it has been the organ for the resistless dissemination of that truth which has taught man the doctrine of an inherent sovereignty; it has been the instrument by which royal and irresponsible authority is restricted, and made sub servient to the superior will of the people; and it must continue to be the enemy of every form of usurpation, whereby man assumes to be the master of his fellow man, so long as it shall be developed in this or any other land.

In the expressive eloquence of Jefferson, it is that which has sworn "eternal hostility to every form of tyranny over the mind of man." Let us now inquire into the origin of this doctrine of "contempt of court." In the early ages of civilization and the exercise of judicial authority in England, the king himself, presided in the courts of judicature, and was, as he is now, the acknowledged fountain of justice. An offence committed by one subject against another, was and is now, an offence against the king; hence in all criminal prosecutions, the Jegal phrase, "The king versus N. As the realm increased in importance the personal presence of the king was necessarily dispensed with, but the presiding barons being the servants and representatives of the king, his majesty is always present, in law, by proxy. Thus in every English court, the king is himself the head of the court, and the sovereign authority presides. "Contempt ol court" is, thcrclorc, ontempt of the sovereign authority, and the king being that sovereign authority, it is con-tempt of the king, and constitutes a sort of petty treason, subject, under the common law, to sum.

Thus it will be seen that "contempt" in England, whence our courts derive the notion and our judges their power, is not an oU'enec against the judge or any officer of the court, in fact; but, an tdlence against the king, and only punishable as such. Now let us apply the principle to the "United States, and see what a farcical idea the action of our city court presents to the mind. A publication is made in a newspaper, professing to detail certain proceedings of the court in a manner which somebody deemed was calculated to bring into contempt what? who? The chief judge? The associate judges? The whole bench? The attorney general? ltis deputies? Or, all com.

'bined? Oh, no! This is not the meaning of the common law.
