7. Special. The outlook is bright for the acceptance of the If T. Murphy did not pull Fred Broens in the fourth race at Harlem yesterday direct evidence seems to count for little. The colt bad been backed by Its owner, J.

W. Schorr, and his price had been lowered from 2 to 1 to 3 to 2. At the bead of the homestretch he was lengths ahead of Bell Punch, and was galloping, while the other was driving. Behind Bell Punch everything was beaten. As Fred Broens came through the straight Jlurphy had a tight hold of his head, which was high in air.

Warren on Bell Punch was working hard, and as the colt is a game fellow he gained gradually. To this Murphy paid no attention, and even when Warren was alongside he let out never a link. When Bell Punch had raced to Fred Broens head Murphy made a show of whipping. It was a pretty finish said one and all. and Bell Punch was first past the post.

Men who had bet on the winner because of his previous victory were astonished, and no one thought that the better horse had won. Colonel Clark called Murphy to the stand, and the jockey explained that Fred Broens would not stand to be hit with the whip, and that young Mr. Schorr told him only to ehow the flail to the colt, riot touch him with It. The horses were placed as they finished. The Professor being third.

After the races were over Colonel Clark said that he had informed Murphy that no more such rides would be tolerated, and that hereafter the whip must be used. The presiding judge eeemed to regret that he was ignorant of the fact that T. Murphy was formerly in the employ of Tom H. Kyan. the owner of Bell Punch.

The latter colt was strongly backed at 4 to 1. and closed at to 1. It is a well known fact that Tom Ryan has behind him a man of wealth, who plays the poolrooms heavily. All the facts go to show the possibility of a killing on Bell Punch, and Murphy's ride on Fred Broens was what landed the money. Effie Cline, favorite at 2iA to 1 for the first race, spread-eagled the field, winning pulled up by several lengths.

The start was straggling. Whistle Wing, backed from 10 down to to 1, threw W. Dean at the post, but he remounted, got off well, and ran second for three-eighths. Baldwin did not know, until The Tribune printed the story, of the existence of this institution, and was astounded and indignant when he found his name had been used to lend a glamour of respectability to the concern. Yesterday morning he started out on the warpath, but somehow or other Longden heard trouble was brewing, and called on him. Dr. Baldwin insisted on all conversation being held before a witness, and soon convinced Longden that the best thing he could do was to at once go before a notary and furnish an affidavit such as he did. This will not end the matter.

Dr. Baldwin feels that he has been humiliated and damaged both in professional and private life, and will make it somewhat torrid for Longden and his clan among whom is the notorious Dr. Armstrong, whose fraudulent practices in the medical college line have been exposed in The Tribune. Sixth race, selling, ft furlongs Reel. 104 Journal 1 0 2 3 06 SMITH Hattie. beloved daughter of Clara pounds Clo'dy "While the Drainage board, the city administration, and the government officials are trying to figure out some plan for improving the Chicago River on which all interests can agree, they say Congressman Mann's statement in Washington is rather more encouraging than the situation at this time warrants.

Commissioner McGann says the city will be guided by such plans as Major Marshall, the government engineer, may present, and he, probably, will not do much until the department at Washington gets a report from General AVilson, who was here some time ago inspecting the river and harbor. B. A. Eckhart and other drainage trustees say they recognize that it will be necessary to work in harmon with tha government. The board's attorneys won their first victory yesterday in condemnation proceedings by getting the right of way through Joliet.

The Circuit Court overruled the motion the attorneys for the Adams property to dismiss the suit on the ground a provision in section 23 of the act creating the sanitary district prohibits the removal of the dam. The court held in substance that the so-called proviso clause is repugnant to the entire act. The court also held that for the purpose of condemnation proceedings the property was sufficiently well described. SERVES NOTICE ON GORDON. Smith.

MARY KUTZ'S HOME. Judge Jenkins on Monday next will pass upon the construction of the celebrated civil service order of President McKinley, issued June 27. The question at issue is whether the order applies to changeB in official position or only to removals from the service. Superintendent Charles W. Carr of Postal Station Englewood, asserts the former is the case, and that Postmaster Gordon has therefore no right to reduce him from a superintendency to a clerkship.

The judicial opinion will be rendered on the hearing of the motion to make the order issued on Monday restraining Postmaster Gordon's action a temporary injunction. The order of the Judge reached Chicago yesterday morning, and service was had upon Postmaster Gordon. The Postmaster will have a conference with District Attorney Black, who will represent him in the construction of the law aa made by the Postofflce department. WILL QUIT BROWN UNIVERSITY.
