A stale district court in September 19K6 agreed with the arguments and the Supreme Court affirmed the decision, saying that because the ski resorts are on federal land and because those using guide services arc not paying for entry into an area, no admission charge can be assessed. In the latest question, both sides asked whether the May ruling applied only to the services mentioned, ski lift and guide charges, or invalidated the Tax Commission's entire ruling. But the court said although it may be asked to resolve the question in the future, it was asked in its original ruling only to deal with the specific services, so a ruling on the issue now would be an advisory opinion. "This court has said repeatedly that it will not issue advisory opinions and we decline to do so now," the opinion said. The court also declined to rule on a question by the parties on how taxes paid under protest by the ski resorts and outfitters while-legal action was pending should be refunded.

Justices wrote that because the issue was not raised at the trial level or on appeal, they could not address it. "Answering questions at this time which concern refunding lax moneys improperly collected would be to circumvent ad-minisiraiive authority," the opo-nion said. CHEYENNE (AP)- Wyoming's Supreme Court refused Thursday to rule on the validity of a stale Tax Commission decision to apply admission taxes to all charges by ski resorts, dude ranches, hunting and fishing outfitters. The court, in an opinion handed down after the rehearing of a case it decided in May, refused to answer the question of whether its earlier decision applied to the Tax Commission's regulation as a whole or just as it applied to ski lift and guide service charges. The opinion stems from a lawsuit filed by the Jackson Hole Ski Grand Targhee Resort, the Triangle Ranch and oiher outfitters and dude ranches against the stale.
