The Montana Standard, Butte, Friday, November 9, 1979-5 Shining Mountains' owners object of $10 million suit VIRGINIA CITY A $10.85 million class action suit alleging fraud and breach of contract was filed Thursday in Virginia City district court against the owners and agents of the Shining Mountains Subdivision. The huge development is located about five miles southwest of Ennis in Madison County. The complaint lists names of more than 103 plaintiffs, identified as owners of property within the three units of the subdivision. Defendants are Don and Pann Mallas, doing business as Mallas Associates, and general partners of the Shining Mountains, a California limited partnership. Also, Nick Mallas, Jess Burgoon and Ray Whitley, agents and salesmen for the development.

complaint alleges the defendants, by fraud and deception, induced the plaintiffs to buy lots in the subdivision and then breached their contracts. The plaintiffs claim they were induced to buy lots by promises that roads would be built as shown on the official plat of Shining Mountains, that a dam would be built on Cold Creek to form a lake that would be stocked with trout and that common areas and common area easements would be for their exclusive use. and 7:15 p.m. Wednesday. There was no report of missing items. Arlen Morrill, 86, dies Longtime Butte resident and former machinist Arlen Morrill, 86, of Browns Gulch died Thursday after an illness. He was born July 17, 1893, to Mr.

and Mrs. Alonzo Hendricksen. He served with the Army's 1st Division Signal Battalion in World War I. He lived in Butte 34 years and was self-employed at the Central Garage. Mr.

Morrill enjoyed hunting and fishing and was captain of the American Legion rifle team 1934-41. He was a member of the Elks and the Masonic lodge. Survivors include his wife, Della; son and daughter-inlaw, Mr. and Mrs. Arlen Morrill Jr.

The contract agreements were breached, the plaintiffs claim, when the defendants in a conspiracy offered those buying lots in the other subdivisions the right to use the -common areas and easements. The plaintiffs also claim the defendants formed the Shining Mountains Owners' Association, a non-profit corporation, on May 24, 1973, to manage the protective covenants of the three subdivision units.

They say a controversy has arisen over the association because the defendants amended the articles of incorporation on Jan. 25, 1978, to include the other subdivisions. The court is asked to rule on the plat provisions relative to the common areas and easements and declare that the exclusive use rights belong to the plaintiffs. A judgment declaring the amendment of the articles of incorporation to include other subdivisions as an illegal act also is sought. The plaintiffs ask $500,000 for building the roads, $50,000 for the dam construction, $250,000 in general damages and $10 million "for the sake of example and by way of punishment of the A jury trial is demanded.

Paul Church, American Legion, Elks and a 30-year member of the -Pipefitters Union. He married the former Jacqueline Jones in Anaconda in February 1977. Burial will in Mountain View Cemetery. Mr. Faller was born in Thornville, Ohio, Nov. 29, 1888. He moved to Dillon in 1912.

He and Ann Shields married Feb. 7, 1921, in Dillon. She survives. He was Dillon postmaster 1924-33, director of the Selective Service and the local employment office, and an agent for State Farm Insurance. Mr.

Faller was a World War I Army veteran, serving in France. He was one of the founders of Beaverhead Post 20 of the American Legion. He also was founder of the Beaverhead Barracks of the Veterans of World War and was a past state commander. He was an active member of the Masonic lodge. Surviving besides his wife are daughters, Joan Davis of Dillon, Ellen Walz of Seattle, Margaret Johnson of San Diego, Ruth Bertone of Los Angeles and Virginia Foster of Wallace, Idaho; 19 grandchildren; and great-grandchildren.
