Jfohmmul gisptclt. MONDAY 1, 1872. The Now Tobacco Law and the Planters. We have received the following note: 20, 1872. I write to request von to the late art of Congress putting restrictions upon the sale of tobacco farmers.

Those engaged in cultivation of lohaceo arc not familiar with this act, and will be much interested in its publication. When does it take effect Respectfully yours, L. C. Randolph." The fact that Congress has made the tax upon manufactured tobacco a uniform one of twenty cents per pound ought to satisfy every one that that body has not intentionally done anything to injure either the growers or the manufacturers of tobacco. Bearing this fact in mind, the reader will better able to form au unprejudiced opinion of the new law than he would be if he were to look upon it as the work of an enemy.

Wc copy so much of the new law as our correspondent wishes to follows Extract No. J. That section fifty-nine be amended by striking out all of paragraphs seven, eight, and ten, and inserting in lieu thereof the following to wit Dealers in leaf tobacco, except retail dealers in leaf tobacco, as hereinafter defined, shall each pay twentyfive dollars. "Every person shall be regarded as a dealer in leaf tobacco whose business it is, for himself or on commission, to sell, or otfer for sale, or consign for sale on commission, leaf tobacco; and payment of a special tax as dealer in tobacco, manufacturer of tobacco, manufacturer of cigars, or any other special tax, shall not exempt any persou dealing in leaf tobacco from the payment of the special tax therefor hereby required. But no farmer or planter shall be required to pay a special tax as a dealer in leaf tobacco, for selling tobacco of his own production, or tobacco received by him as rent from tenants who liave produced the same on his land.

But nothing in this section shall be construed to exempt from a social tax any farmer or planter who shall, by peddling or otherwise, sell leaf tobacco at retail directly to consumers, or who shall sell or assign, consign, transfer, or dispose of to persons other than those who have paid a special as leaf dealers or manufacturers of tobacco, snuff, or cigars, or to persons purchasing leaf tobacco lor export. And it shall be the duty of every farmer or planter producing and selling leaf tobacco, on demand of any internal revenue otlicer, or other authorized agent of the Treasury Deportment, to furnish said officer or agent a true and correct statement, verified by oath or affirmation, ot all' his sales of tobacco, the hogsheads, cases, or pounds, with the name and residence, in each instance, of the person to whom sold, and the place to which it is shipped. And any such farmer or planter who shall wilfully if fuse to furnish such information, or who shall knowingly make false statements as to any of the shall be liable to a penalty not exceeding live hundred dollars. "Dealers in leaf tobacco shall hereafter sell only to other dealers who have paid a special tax as such, and to manufacturers of tobacco, snulf, or cigars, and to such persons as are known to be purchasers of leaf tobacco for Extract No. c.

Retail dealers in leaf tobacco shall each pay five huudred dollars, and, if their annual sales exceed one thousand dollars, shall each pay, in addition thereto, titty cents for every dollar in excess of one thousand dollars ot their sales. Kvery shall be regarded as a retail dealer in leaf tobacco whose business it to sell leaf tobacco in quantities less than an original hogshead, case, or hale; or who shall sell directly to consumers, or to persons other than dealers in leaf tohacen who have paid a special tax as such; or to manufacturers of tobacco, snuff, or cigars ho have paid a special tax or to persons who purchase in original packages for export. Planters arc not prohibited from selling their tobacco, but merely from becoming non-tax-paying retailers of it, to the detriment of persons who have paid a tax for the privilege of retailing tobacco. They may sell to consumers upon paying the tax required of all other persons who retail tobacco.

Now, if this provision of the law requiring all persons to pay a tax who sell tobacco, to consumers a wise and fair, and therefore unobjectionable on follows that the collateral provision allowing planters to sell without paying a tax only to such as have themselves jwid a tax Hs also a wise and neccssary one; for if the planters were allowed to sell to any and everybody, whether the purchaser had paid a tax or not, the law requiring them to pay a tax for selling to consumers would soon be a dead letter, inasmuch as in the absence of the requirement to sell tax-free only to persons who have themselves paid a tax, the planters could sell in any quantity to anybody, whether a consumer or not, and thus work at; iiy ury to dealers who, not raising tobacco, have to pay a tax for the privilege of selling it to consumers. The further provision that the planter shall furnish a statement when required of all his sales of leaf tobacco may cause some little trouble, but not much. There has been no such law in existence heretofore, and yet we venture to say that there is nut a planter in Virginia who cannot tell how many hogsbrads of tobacco he sold last year. The person to whom he sold it is often the commission merchant. Whenever he consigns his tobacco to one of these for side, he sells it to him In contemplation of the law.

The planter is only to be punished when he knowingly makes false statements or wilfully refuses to make any. Nevertheless, it will be best for planters to keep accounts of their sales. All planters should do this anyhow. He is a very careless one who does not do so. There is uo hardship ifi this requirement.

No one is intended to be affected by it except persons who, paving no tax, have heretofore sold leaf tobacco in small quantities to others to be smoked or chewed. The whole design of this section is to prohibit such sales entirely, and to send consumers to persons who pay taxes. Extract No.

3 concerns only such persons as wilfully violate the law. No planter will do so. On the whole, we do not complain of the new law. We think it will not be enforced ill an oppressive manner. We are sure it will not be when Ghkelky shall have sent the earpcl-kiggcrs home, and.
