Among them were Nadine Ehrhardt and her children, Brett 4, and Shannon, 7, of rural Bismarck. They were in a car that was rear-ended at State Street and Divide on Nov. 19. Because they were wearing their seat belts, they avoided serious injury, said Bismarck Police Officer Barry Mayher, who investigated the accident.

The Ehrharts' car was totaled and its back bumper was pushed all the way up to the rear seat from the force of the impact. The children get a big teddy bear wearing a seat belt in addition to the usual plaque. Others honored were Janice and Ralph Bunting, 1226 N. Mandan Polasky also made a special -point of recognizing the boys' par- 1 ents for encouraging seat belt use. Six people from Washburn who received minor injuries in a July 5 accident on U.S.

Highway 83 will be presented their awards by Wash-burn Highway Patrol Trooper Ricky Richard. They are Sherry, Cody (age 13 months), Barry (4), Dustin (7) Kinnischtzke and Cathy and Timothy (7) Forsch, who were all in a car that was broadsided by another driver who failed to yield at a stop sign. The awards are given periodically by the North Dakota Highway Patrol and the North Dakota Safety Council. Bismarck, and George Fried Jr. and his brother, Michael Fried, of rural Mandan.

The Buntings were injured Sept. 20 in a three-car accident at an Interstate 94 construction site at West Fargo. Ralph Bunting told the investigating officer he was sure he would have gone through the windshield had he not been strapped in. The teen-age Fried brothers escaped serious injury on Dec. 12 when their car went off Interstate 94, down an embankment and rolled.

If they had not been restrained by seat belts, they could have been ejected and killed or seriously hurt, said the investigating officer, Trooper Don Polasky. Highway Patrol officers can talk until they're blue in the face about seat belts savings lives and people will say, "They're getting paid to say that." But when ordinary people attest to being "saved by the belt," more people listen. That's the feeling of Bismarck District Highway Patrol Capt. Pius Ternes. And he said so during the "Saved By the' Belt Awards" Tuesday in Bismarck, where it was announced that 13 people are being Barb Evanson, Bismarck Bill Bowman.

Cavalry at Wounded Knee, S.D. Harold Iron Shield of Vermillion, S.D., said the drive is being carried out on behalf of the Wounded Knee Survivors Association. However, Mario Gonzalez, an attorney for the association, said the association is not involved in the petition effort. Iron Shield was involved with efforts to have 1990 declared a Year of Reconciliation between Indians and whites in South Dakota. In December 1890, hundreds of Sioux men, women and children were killed by calvary officers.

"(Last) Friday he told me he would be making a decision in the next couple of weeks as to what our path would be on the Missouri River," Gretchen Lord Anderson said. "He has his legal team organized, and they're putting together theirpleas." The states lost a similar lawsuit last year when they sought to decrease water releases from South Dakota's Lake Oahe reservoir to protect the 1990 walleye spawn. The issue reached the 8th U.S. Circuit Court of Appeals, which dismissed it.

However, the judges did not rule on the question of whether courts have any jurisdiction over the corps' water management. The states contend the corps' operating plan protects downstream shipping interests at the expense of upstream fishing and other recreation by drawing too much water from the reservoirs in Montana and the Dakotas. The corps says it works hard to balance the needs of upstream and downstream states, despite the drought of the past few years. Nicholas Spaeth, North Dakota attorney general, said the upper basin states have a better chance to win a lawsuit this time because they have more time to prepare it. Wyoming also is considering joining the suit, he said.

Corps spokesman Paul Johnston said a second lawsuit would be unfortunate, but would not hinder the agency's work on its master operating plan for the river. Upper Missouri River basin states are preparing a second lawsuit challenging the U.S. Army Corps of Engineers' management of the river system, North Dakota state engineer David Sprync-zynatyk said Tuesday. South Dakota and Montana have joined North Dakota in preparing the latest legal action, Sprync-zynatyk said. "I participated in a conference call (Tuesday) morning with the other states," he said.

"I think that probably within two weeks' time we'll be in federal district court once again." South Dakota Gov.
