Last Night. The council met in special session last evening. The ity civil engineer reported! that William Kown was not carrying outi his contract to build gutters on Morrison! strtet, and the city attorney was frdered; to bring suit agaicstjhis bondsman. The; engineer also reported that $011.55 be paid; Dunning 4 Hudson for grading, bowlJer i ing snd cuiblng the sidewalk ef Georgia street from Illinois to Tennessee street. The fire board recommended the location of two barrel cisterns near the Sarven wheel works.

The public light comnjittee reported in fsvor of the renewal of ithe contract with the gss company. There was an expression in jfaror of so making the contract that it could be revoked at any time on giving the ras company three months notice. The! idea was to enable the city to use electric light if deemed advisable. The report was referred back to the same committee, the judiciary committee and the city attorney. An ordinance waa introduced to grade ai.d bowlder the gutter on West street from Washington street to Indiana avenue.

Th Board ot Health Explains. The board of health send in the following communication relative to a publication in yesterdsy's To the Kdltor of be Indianapolis News.

You do the board of health an injustice In your yesterday's paper, when you intimate that a want oi courtesy ana interest was manifested in ody one member of the board meeting Mr. Croes, the Kew York engineer. The faets are. that two weeks before, the board of health were Informed that before any conclusions were arrived at, or any plan adopted, the board should; hsve an opportunity of meeting with Mr. Croes, and disousng the proposed plans; we anxiously waited for a notice.

On Saturday last at one rUarter pat eleven a. Mr. Dyer called at Dr. Meier's office and invited the board of health to meet Mr. Croes at 12, nooh, just 4b mitintes verbal notico.

He stated that he bad not notified the other members. Dr. Elftnn was away from the city, t'pon calling upon Dr. Jefli ies it was found that he was visiting patients. Dr Elder then met Mr.

Now, we think that the board were not to! tilsme at all whea jrentlemen or ctToraUons detilre an interview with the nrn i niciral officials of a city, a written invitation isj Kent long enough in advatfee to allow them to make arranKtments for attending. Nothing of that kind was done, although a two weeks old promihe was lending. Judge of the mortiflca Uon and surprise of the member who did meet Mr. Croes when he waa informed that the work wk done, the surveys' complete, the plan de cfcled upon, tie report ready, and Mr. Croc had ariaugcd to leave the city tli aftemsoa.

It Micmed that a conference with the bjarfl of health was not regarded as essential to 'he Adoption of a plan of watersnpply. This whining atxut discourtesy on the part of the city officials is unworthy of business men. The Interests of the city were not considered or cared for; the iiui waa alljtbat entered into the consideration, of the eae. Plans and recommendations were plenty enough, but itwas predetermined tan' only a certain amount of money should be use1 consequently a plan was recommended that lind only the merit of cheapness, and on a LI oilier ground stands condemned by the alnio. universal our citizens.

Wood, who died yestfTday morning at the residence of btr son. John at the aee of ninety, was noted In her day for the lib erality with which she dispensed her hus hand's very considerable wealth in benev olent deeds. So more generous, true hearted woman ever lived, and never was one more affectionately regasded by her friends. She cam here forty seven year ago, witb her husband, who owned the finest farm in county, just south of the city now partly incorporated into it on Pleasant Kun. The Beatty addition is pert of it Here he bred and fed horses for the New Orleans market, and for a time was successful.

The "hard times" of; '40 and thereabout, however, troubled him greatly. He died in 1847, some twelve or thirteen yean after he came here. For a generation Mrs. Wood has lived in a little house adjoining her son's, en North Pennsylvania street, devoted to charitable and religions duties. She was ene of the early members of the Christian church in Kentucky, where that faith took deep root early, and came here tSe next year after the organization of the church here.

She was a member from the time she came till she died. Four children survive her: John M. Wood, Mrs. McK. Dougherty, of Colum bus, Ohio; Cornelia, widow, of Robert ex Chicago, and William E.

at one fell swoop. Gen. McGinnis stat is the commissioners made the appointor int by the advice, and with the consent of Mr. Harris, county attorney. He states; there is no law directly authorizing the cemtnis sioners to make such an appointment, but that accerding to Mr.

llarr it is not forbidden. The law otr the subject is embraced in sectioji 147 of the act concerning taxation, approved March 29, 18X1, and section 39 of" Bie act concerning fees and Salaries, pairefl42 of the acts of the special Bession ot The first, after reciting certain duties jibf the auditor, makes the provision "that no pes son other than the officials provided: for in this law shall be employed by the commissioners to discover omitted The second says Tli jard of county commissioners sh less in cases of indipensable public to be found and entered of record as part orders, make no allowance not specifii quired by law to any county auditor ill, un sity. their Jy re ef erk. lieriff, amesnir or treasurer, either din rtly or liidiiectlv, ijortosy cleri. deputy, bsJlitt, or any employe of such officer, nor shall taoy, ex tcpt in caes above provided, employ any Person to perform any duty required by La of any oRU er, or for any duty to be pid Dy iinmis sion or percentage; and for a violation ofilhe provisions of this act each member of such bjbard favoring the same shall be guilty of a misdepieanor, and, on conviction, should be finel in S3iy sum not less than double, nor more than fire ttmcs the amount of such allowance, to wlilchj.lnay be added imprisonment in the county jail for any period not more than sixty days, and the othca of such comraihsianer shall be declared forfeited.

County Attorney Harris holds that, the re otrirtion3 of the laws referred only to what is known as "sequestered" property; thHt Cooper wns employed to look ap and collect delinquencies in the matter of "personal" property. These "personals" include the delinquencies of young men liot entire taxables consist of gold watches, jewelry, or articles of that sort, whose Diiines have been dropped from the dapli ct.Hs. It is, therefore, seen that the law ppainst "ferrets," which the people so riotously demanded, Lai been su framed that "a coach and six" can be driren through it, snd the will of the people has been practically annulled. Tobacco Smoker to tbe Bear, To tbe Editor of The Indianapolis New You hare proven a manly champion of iaanr much needed reforms.

There is Another evil under the sun against which I think the sufferers have the right of If you agree with me, please take up the cudgel in our behalf, and don't lay it down until all the tobacco smokers are sent to the rear platform of our street cars or compelled to walk. Every morning I ride down the entire length of one of our long lines of street cars, having quite often a long walk to reacli the car. As Ihe car starts I congratulate myself upon a cool, breezy ride, as a restful beginning of a day of hard work. But lo! there never fails to step onboard one, two, three, and sometimes tour gentlemen with cigars. Sometimes they are polite enough to carrv them the entire trip in their hands, without smoking, but invariably one or two plant themselves upon the front platform and complacently smoke away, the smoke sweeping back through the entire car.

Perhaps it is my misfortune' to hare a consti tution which I have never yet been able to accustom to the endurance of tobacco smoke, but misfortune er fault, certain it is to that to inhale it for sny length of time insures me the sick headache. Now, I spend my days usefully. I am not a sickly, neither am I a useless woman. I have a right to ride to and from my day's work, and I have a right to ride in physical comfort If I were the only sufferer it might be selfish for me to protest, but I know there are many women, and many men, toof who would like to breathe God's free air untainted by tobacco smoke as, they ride down town in the morning. I believe there is a rule against smoking in street cars, but men may as well smoke in the car as on the front platform, or standing in the front door.

They seem to thinkf their feet the thresh hold their right is indisputible. I know there are tobacco smokers so selfish that they do not care whom their smoke annoys in a public vehicle. Bat I do not believe many of those gentlemen I have seen on our cars in the rnorning wonld do so if they really thought a lady was fairly holding her breath, lest by inhaling their smoke she have a headache all day. I respectfully ask in the nam? of the many aftlicted, that the street railway company make a rule and insist on its enforcement, requiring tobacco smokers to take the rear on our streetcars, or ride. without lighted cigars.
