C. Jan. 18. A controversy between cltisens of California and Nevada. Involving the right to use tor irrigation and other purposes tbe waters of the Walker river, which flows in both stales, and attacking the jurisdiction of tbe United States Circuit court of Nevada to Interfere In the title rights to lands in California, was argued in the Supreme court ot the United States today.

1 The case was orgiclally entitled: "Millf Lux vs. Thomas P. The plaintiff." own about 23.000 acres ot land in Nevada. Wine alone the Walker river, and the de fendant, Rickey, and associates hold title to about 40,000 acres located In California along the head waters ot the same river and above the Miller Lux property. Miller Lux begun the original action in the L'nited States Circuit court in Nevada in to restrain tbe Rickey interest from using the waters of the Walker river In California, which they alleged deprived them of their supply in Nevada.

Rickey pleaded lack of Jurisdiction on the part of rhe court, but Judge Hawley of the United States Circuit court of Nevada held that he had a right to regulate the titles to land in California. The defendants then brought suit in the Superior court of Mono county, California against' Miller Lux to quiet title to. the Cslitornia land. Judge Hawley, upon application of Miller Lux, enjoined this action on the ground of an invasion of tbe jurisdiction of the federal ccurt. The Circuit Court of Appeals at San Francisco sustained tbe Injunction and the case reached the United States Supreme vourt on appeal of the Nevada parties from that affirmation.

The case is similar. to that wherein tbe waters of the Arkansas river were in dispute between the citisens of Kansas and Colorado some years ago. and which were decided finally In favor of Colorado. The decision in thai case, however, waa founded upon tbe presumption that' the people of Colorado would be more seriously damaged by a decision against them than would the people, of Kansas. The interstate commerce commission has announced that four hearings, supplementary to that held in thia city last week oa-substitution ot commodities In transit, will be held. The first of these hearings will be held in Chicago on Jan. 25. Millers and other tran sit shippers of tbe west and Northwest are expected to be present. Thereafter at early dates bearings will be held at Boston.

The duty on automobiles la 45 per cent ad valorem, btnee the government stood to lose exactly $450.
