SAYS CITY HOLE RIGHT IN DRINK LAW Levy Mayer, in Replying to Suit Begun Against the Mayor, Declares Chicago Possseses Abso-ulte Power to'Regulate Traffic AUTHORITY HELD GRANTED UNDER ITS FIRST CHARTER Counsel for the Sunday Closing League, Which Instituted Action, Maintains That the State Is Supreme in the Matter. At sertlng that the city of Chicago has sl-ways, since its first incorporation In 1137, the sbsolute right to regulate the liquor traffic within its limits. Attorney Levy Mayer csrried war Into the camp of the Sunday closing bodies in their fight to close the saloon of Alderman Michael Kenna and thirty others on the first dy of the week. Attorney Mayer in filing "the answer of Edward F. Dunne, as mayor of the city of Chicago, 111., to the petition for mandimus of the- people of the stste of Illinois." states that by the terms of the first charter granted the city the right was given to the city to regulate the sale of liquor for every day of the week, and that this right has never beta revoked.

The move of Attorney Mayer threw the ministers and others, especially the socialist element that is interested in the esses against "the rich and prosperous" aaloon-keepers. into stale of excitement, but no definite plan of fighting it was announced. Leasae Helda Slate Satpreane. Attorney W. J.

Miller, counsel for the Sunday Closing league, stated It wts probable that the contention in answer to that of Attorney Mayer will be that no matter what the laws of the early '30s called for the present courts must hold that the law of the state Is in every case supreme. "It makes no difference," he said, "what law, provision, or other suthority has been discovered, the fact remains, ws hold, that the present state law is supreme, and that no regulation, act. or charter provision madir previous to its passage that conflicts with it can stand. The state law under which we are endeavoring to close the saloons Is, In my opinion, above all other laws and regulations, and will prevail." Corporation Counsel Lewis, who, with Assistant Corporation Counsel Murphy, signed the answer, insists there has been no legislation referring to the closing of saloons in cities and villages since the original act, 'ind that t'ue present state act refers only to the issuing of licenses. Rights granted to the city in 1S3T, 1SS1, 1863, and 1875 are referred to In support of the stand taken against the mandamus proceedings.

RcTseallsa of l.Iceataea. It is also pointed out that the mayor can only close or take away the license of a saloon when he has evidence against it, and that for his honor to procure evidence against the 7.000 odd saloons in Chicago would be a physical Impossibility. Attorney Mayer asserts tbat the city has since 1837. except from June 23. 1862 to Feb.

12. 1S53. been regulating the ssle or giving -it ay of liquor In Chicago on all days of the week, including Sunday. He points out that the common council has always allowed the sale of Intoxicating liquors on Sunday, with the one exception "that all doors opening out upon any street from, such bar or room' Sffcere are sold, and all windows opening upon any street from the bsr of room where such liquors are sold on Sunday must be provided with blinds, shutters, or curtains, so as to obstruct the view from such streets into such room."
