By the ninth clause of the will all the residue of bis estate was left to Henry W. King and nine others, as trustees, to be applied in founding or endowing, on a lasting basis iu Chicago, 6uch a charitable institution as would, iu their ooiulon, do the most good. In case the majority of the trustees should deem it Inadvisable to organize a new charity, tnen the amount was to be paid over to the managers of the Home for the Friendless. The majority of the trustees then signed a document, holding that, in their opinion. It was inexpedient to organize a new charity.

This threw tbe whole amount devised by the ninth clause into the hands of the Home t-r the Friendless. A bill was Hied at once In the Circuit Court to set aside the ninth clause on behalf of tbe heir. This bill was dismissed by Judge Williams for want ot equity, and the trustees were directed to pay over the money under tbe terms of the wllL An appeal was taken from this decision to the Appellate Court of this district, by whom the nintn clause in question was held to be void for uncertainty. An appeal was then taken to the Supreme Court, where the case is now pending. Under these circumstances the guardian explains to the oourt that she has been aw! vised by counsel that the manner in which the Supreme Court will decide the question is extremely doubtful.

After bearing the arguments of the various counsel on tne subject. Judge Knickerbocker, consulting tne interests of the ward, and feeling that grave doubts existed as to the decision of the Supreme Court, entered an order authorizing the compromise to be carried out. This ends a tedious litigation, anu would certainly seem to be a wise course for both of the interested parties. THS STATE SAVINGS IW3riTT7nOH The receiver of the State Savings Institution filed a petition yesterday before Judge Tuley In which be states that he holds 200 bonds of the Chicago and Pacific Railroad Company. This road was recently sold fcr 16,000, and the proceeds, after payiDg a large number of claims not yet ascertained, will pay about 33 cents on the dollar on the bonds.

Some time must yet elapse, however, before the settlement, and the receiver thinks it of tbe utmost importance to declare another dividend to the depositors To do this money must be raised. He can borrow $50,000 ou the security of the Chicago and Pacific bonds at 8 per eent Interest, without becoming liable to repay the amount in any case if the security fitils. Even if Interest has to be paid on the loan It will be better, ba thinks, than delaying a dividend. Judge Tuley entered an order authorizing the loan, and another dividend will proDably be declared without delay. TEX WX.

It strikes at the root of the tree, the groundwork ot the Constitution, liberty of speech, of tbe press, of eonsoienee; and the right to bear arms, together, constitutes the1 grand palladium which makes man a man, and not a subject.
