Ilk lit 5 JitcA pl Drowning lawsuit settled By Gary Metro Journal Times Racine County Judge John Ahl-grimm on Monday approved a $100,000 settlement for an 8-year-old Michigan girl who nearly drowned in a 1986 motel swimming pool accident.

A second Michigan girl died as a result of the accident. Racine attorney John Becker, who represented the surviving child, said the minor court settlement would end civil court litigation connected to a July 5, 1986 incident in the swimming pool at the former Clayton House motel at 5005 Was-ingtonAve. The motel is now known as Apple Valley Lodge. Matrina George, who lives in the Detroit area, was awarded the money. Becker said the award to the girl, who was hospitalized for about a month after the swimming pool accident, would end a lawsuit against the motel and its insurer.

The second victim, Eva L. Tyson, 8, of Detroit, died as a result of the pool accident, following about two months of hospitalization. The motel's insurer has agreed to pay a total of $420,000 in connection with the pool accident, according to Becker. He said the settlement calls for Tyson's mother, Willa Tyson, to receive $170,000, and her father, Kelly Tyson, to receive $75,000. In addition, Blue Cross and Blue Shield United of Wisconsin, will receive $75,000 as reimbursement for medical expense payments, he said.

The children were guests at the motel when the accident occurred, according to police, who said the girls were staying with Willa Tyson and Virgie George. A mote patron and bartender pulled the girls from the pool after they wandered into water that was over their heads, according to police, who said the children panicked and slipped beneath the surface. Both girls were unconscious when they were pulled from the water. Before the resolution was passed, one liquor store for each 3,000 residents, with a limit of one store per ward was allowed. Supervisor Charles Stratman, who introduced the measure, said a growing demand for liquor stores in the town made it necessary for the board to increase the quota. Also at the meeting, the town board combined several wards to handle the Feb. 16 primary elections. The wards voting in the school board primary elections are: wards 1, 2, 3, 4 and 12, which will vote at the town hall, 6126 Durand wards 5 and 6, at the Lake Park Fire Station, 3809 Sheridan Road; and wards 10, 11 and 13, at the Roma Lodge, 7130 Spring St.

Wards 7, 8 and 9 will vote in both school board and county supervisor primaries at the Quarry Lake Park service building, 3800 Northwestern Ave. Wards 7, 8, and 9 will vote in the three-person run-off in the District 17 county board supervisor race between Elizabeth Miller of 4848 High Meadows Terrace, Ralph Trower of 5702 Cambridge Lane and LeRoy Seeger of 221 S. Herold Journal Times MOUNT PLEASANT The town board approved a resolution Monday that absolves the town of any liability associated with mailboxes damaged or knocked down by town snowplows. The resolution formalizes an unwritten town practice, Town Administrator Robert Beezat said. But because a few residents have complained about damaged mailboxes in the wake of December snowstorms, the town wanted to make its policy official, he said. "Occasionally when the snow is plowed, the mailboxes get knocked down," Beezat said. "The town is not liable for the damage." Mailboxes on public property along roadways are considered an encroachment under state statutes, Beezat explained.

But the state allows them as a convenience to residents, he added. In other town matters, the board passed a motion that raises the limit on liquor stores in the town from seven to 11. The board also an-nouced the polling places for primary elections in February.
