WAS' DRUGGED Startling Testimony InWbol Superior Court Yesterday. A PLEA OF RYDER'S ILLNESS Causes Judge Butt To Hava Dr. Bard- well Examine the Prisoner. FINDS HIM IN A VERY STRANGE CONDITION Intimates That He Had Been Given' Some Opiate Motion for a Change of Venue Overruled. Talbotton.

Ga. May 28 Special. Evi dence to support the motion for a change of venue was introduced until 11 30 a. m. With two exceptions all the witnesses put up by the defense believed the defendant could ha a fair and impartial trial in this county.

The state brought forward a number of the most influential men of the county. who believed that. the defendant could. have a fair and impartial trial. On yesterday the defense introduced an affidavit from two physicians of Macon who stated that they had been called to see Dr.

Ryder and found him unable to travel to Talbotton. It happened that Judge Butt learned that Dr. E. 1. Bardwell.

of Talbotton was In Macon. and he wired the doctor to examine Ryder end come to Talbotton on the morning train and report upon his condition. Dr. Bardwells Testimony. Dr.

ell reached the courthouse about o'clock and was put on the stand. lie stated that he examined Ryder about I o'clock this morning. and found him prost His pulse was six his temper- ature 36 8 and his skin dry. Being asked what he thought brought about this condition he answered that the condition might be called nervous prostration. but that to him he had the appearance of a man who had been drugged.

He did not mean to cast any reflection upon the physicians who had been attending Ryder that the medicines had the name of the druggist who compounded them. and the numbers of the prescriptions Being asked It the medicine could not have been poured out of a bottle with' the druggist label' on it and other drugs substituted he answered Yes It Caused. Commotion. This intimation of treachery upon the part of some interested one was a bomb thrthwn into court. and just what will be the result cannot be seen.

The argument upon tho motion for a change of venue was opened by Colonel Thornton. who was followed by Colonel 3. H. MeGehee for the state in the best speech of his life. which electrified all who heard him.

Mr. A. A. Carson. for the defense.

spoke for nearly an. hour in a strong argument in favor of the. motion. The speech of Hon. J.

Martin who Is known for his lucid argument and analytic- al reasoning was fully up to the mark he bs formerly set. Hon. Worrlll for the defense. spoke to the motion in a strong manner and exhausted all argument in behalf of the mo. tion.

The Motion Overruled. The motion for a change of venue was overruled. but on account of the prisoners condition court was adjourned and the case cannot be heard now before the September term of the court. Judge Butt was right In his ruling. Ryder can get pa fair a trial here as anywhere in Georgia.

The real question now Is will Ryder ever be brought into court' The people do not believe he will. They expect the same hand which drugged him in Hibb county jell to work some other' scheme Lefore September and that this great case will never be enacted here. The people feel outraged and many of them have lost faith in the power of the courts to deal with criminals who are backed by money and Influence. ON TRIAL AT DALLAS. and a verdict bf guilty rendered on clrcumstancial evidence. A motion for a. new trial was Sled heard and ruled. and the case. went to the supreme court.

In the eastern part of this county owing to an assault that was committed last Sunday by Bud Posey ant EH Johnson on la Johnson. sixteen years old all tie- gross. Posey and Johnson were put on trial this afternoon. The girl Is said to be halt- witted. Posey has been arrested twice before for the same offense but has always come clear.

Arrest of Several Negroes by the Police of Americas. Amerlcus Ga. May The police have captured three negroes whom they suspect as being implicated In a. number of petty burglaries committed here within the pat two weeks. A raid was made Sunday night upon the store of John T.

Taylor on Cotton avenue. and some money and a lot of pocket knives stolen. Last night the police ed George Waring. Ed arid Henry Tucker. upon each or whom was found some of the goods stolen.

SANK IN THE CHATTAHOOCHEE. Going Down of the Queen City" in the River Below Columbus. Columbus. Ga. May 2t Special Kews reached here tonight of an unfortunate accident which happened this afternoon to the steamer Queen City of th Merchants' and Planters' Line.

A hole of such size was torn in the vessels bottom that it sank. Fortunately the river is very low. owing to the lack of rains arid at the point where the accident occurred the stream was only about three feet deep. JeffersonvJlle. Ga. May K. The trial of Criswell bad an abrupt termination this morning It was ft lightning stroke from a. clear sky.

As slated in yesterdays special the Jury had been toads and three' witnesses examined. The case had made fair progress yesterday. under the circumstances. The jury was pujt In charge of bailiffs under the charge of iia honor. and were- promptly In court at the hour of assembling this morning The states counsel asked that the jury be sent put and the fact developed- that two of the Jury who had duly qualified were relatives of the wife of the former prosecutor Deputy Shertr James Id.

Smith. It was-also developed that one of the Jury who had duly qualified and been selected after being placed on his volt- dire. had some months ago expressed the opinion that the defendants would be acquitted and that they ought to be. because If guilty they had been sufficiently punished already. This was denied by the juror.

but Judge Smith deemed the evidence sufficient to have the solicitor issue a rule against him. Had Talked to the Jury It was also proven that Mr. Glover a brother law of two of the trial jury. had talked to these two this morning and that on yesterday he was offering to bet that there would be an acquittal or a mstrlaL All of these circumstances caused Judge Smith to declare a mistrial and the jury was discharged foom the consideration of the ease. These circumstances created decided sensation and at noon today the case was no further advanced than before itwas sounded yesterday morning.

Colonel Joe Hall took exceptions to the judges ruling maintaining that the warrant on which Criswell was tried at the original commlttment trial had been dismissed that Mr. Smith was not now the prosecutor and. therefore. the relationship of the jurors to Smiths wife had no bear. ing upon the case whatever.

Mr. Rogers the marshal of Cochran is now the prosecutor At this Juncture there was some ver sharp and snappy sparring between Colonel Joe Hall and Colonel Nat Harris who at this time took an active part the prosecution for the first time. Indeed. was a good deal of sputtering and caustic remarks indulged in by nearly nil oT the attorneys employed in the case. Colonel Hall continues to wear the fierce look out of his eyes.

which seems to have grown chronic with him and there was a cast Iron expresson of displeasure on the countenances of all of the lawyers which remained with them for a. long while. There was certainly some temper dlsplaed and no doubt whatever that these. legal gentlemen have allowed ther feelings in this case to run away with their better judg. menu and usual ChesterflelJlan urbanity After Mr.

Hall had been overruled in all of these matters to which lie made excep. tions a new jury was finally made and the examination of witnesses began. Train Officers Testify. Captain Lowry who was In charge of the wrecked passenger train. testified on cross examination that he did not consider a trestle that would sink down on ene side three or tour inches when B.

train was passing over it safe nor did he consider a trestle where the heart. of the supports was not larger than hs as safe. This seems to indicate that Colonel Hall intends to prove this to have been the condition of the trestle at. the time the wreck occurred. The conductor of the wrecked freight tram testified that.

some new piling had been placed under the trestle since the wreck. All have testified thus tar that the Umbers were all sound. That the case will develop some big sensations seems to be the opinion of all and the fur is expected to fly from some source before the case is ended. The ease has been In an almost inextricable tangle most of the day. Many exceptions have been filed by the defense and the case will certainly go to the supreme court if the defendants are found guilty Criswell asked Sheriff Jones today hat he thought would be the result of the triaL The sheriff answered he did not know.

Criswell then requested that the. sheriff would hang him publicly In the event of a conviction. He said he would as soon die that way as any other way. Colonel Martin of Hawkinsville is now. conducting the examinations for the.

Presbyterian church. The church was crowded with friend or the' deceased. Mrs. Llpscomb. the youngest daughter of Captain Talmadge who had been in Washington.

Yesterday afternoon at 3 o'clock the fu neral' of Mr Moses Myers was held at the synagogue an immense concourse- of friends being present to pay the last tribute of af- Yection to the memory. of the deceased. Rabbi Rubensteln officiated In an impressive manner. At the grave the remains of Mr. Myers were burled with Masonic honors.

It has been many daj since Athens was celled upon to bury on one day two as prominent cltxens as Captain Talmadge and Mr. Myers. Tearing It Down. The work of tearing down the First Baptist church building teas begun and soon the work upon the new 118000 edifice. will begin.

The last sermon In the old church was preached by Dr. W. H. Young Sunday Among the attentive listeners was the venerable Professor Williams Rutherford. who was a member when this building was erected and who has lived to see It torn down.

Professor Rutherford has been quite ill for some time but is now consid. ct-ably Improved and the Indications are favorable to his complete recovery. The vestry of Emanuel Episcopal church has awarded the contract tot- finishing up their handsome new building on Pt-kite avenue to Watson Bros. whose bid was 31000. The church is already about halt completed.

Watson Bros. will put a large force of hands at work there at once and will rush the ork rapidly. Tomorrow morning at 9 o'clock the closing exercises' of the Athens city schools Will be observed. At Washington street school an interesting programme of song and recitations has been arranged. The graduating class will read essays and the diplomas and Burke scholarship medal will be delivered Professor D.
