A suit for separata maintenance which has just been dismissed in the McLean county Circuit court by the complainant, a woman of 70, calls back -pioneer days. The suit was filed 'against William Elbert, a well-to-do farmer ot Lexington, this county, by Mrs. William Erb Df Pine Grove, who alleged that she married William Erb, or, as he Is now known, at Pine Grove on Dee. 11. 1849, and that, after three children were born, she was leserted in 1854 snd that she heard nothing from her husband until within the past year, when she located him in this county under another name.

Erb left his wife and, turning over to her all his possessions, struck out for the West to make a new a new fortune, and a new' name. He did all three, married again, and for nearly half-century has been a blghly reipected member of the community, no one suspecting that he had previously married until the suit was filed against aim here. After Erb left Pennsylvania it was generally supposed that he had been murdered and searching parties were organised.

The House today passed the bill ordering the state fish and game warden to Institute condemnation proceedings fcr a fishwsy through the dam at Bonaparte. This dam is across the Des Moines -river and Is only a tew miles above Us mouth.

Being a high dam, it prevents fish from coming up the river in the spring, much to the disgust ot the sportsmen of the state. For years they hsve been seeking to compel the Meek owners ot the dam, to construct a fishwsy through it, but they were beaten In the Supreme court about a year ago. state wilt now attempt to condemn the fish way and will pay the costs. The bill has al-eady passed the Senate and will be signed by the Governor. The Attorney General today delivered an opinion! that the Dunham standard policy bill, which authorises the Auditor of the state to prepare a form of standard policy, is unconstitutional, on the ground thst it delegates legislative powers to the Auditor.

The House today recalled from 'the Senate Its motion to adjourn on April and a motion to reconsider was filed. This mesne that the Senate will have to take the inltia tive and declds on the date to adjourn. The compulsory-education bill la made a special order, in the Senate for next Thursday. It has already parsed the House, but its fate In the Senate ta doubtful. The Vicksburg and Sbiloo appropriation bills have been made special order in the Senate for next Wednesday.
