If Peru, when it seized the U.S.-owncd International Petroleum company's properties last Oct. 9, did not "expropriate" them, then the U.S. Ilieken-looper Amendment will not require Washington t0 cut off Peruvian aid by Apr.

The behin.d-sren.es suggestion that Washington could avoid the" April crunch by changing the word applied to Peru's action came to Washington through a Latin American who had direct talks with Peru's tough-acting military president, Gen. Juan Velasco, it was learned Monday. Through the unofficial intermediary, the Peruvians said they have only "intervened" the oil company's properties until they decide how much the company owes them.

Official Peruvian Commissions now are investigating the oil company's tax records to determine whether the oil company recently spirited up to $15 million in cash assets out of the country. "Intervention," a government take-over common in Latin America, is roughtly equivalent to "conservatorship" in the U.S. In the U.S. "Conservatorship" occurs when official regulatory agencies take over regulated enterprises like banks, insurance companies, airlines or railroads that are in financial or management difficulties. In Latin America, intervention is often used for purely political purposes. Though President Nixon in his Mar. 4 television interview expressed optimism over the ice-jam in U.S.-Peruvian relations, State Department officials insist on these two points: First, the Hickcnlooper sanctions named for former Senator Bourke Hickcnlooper Ia.) will have to apply on Apr. 9 unless Peru starts "meaningful talks" about compensating the oil company for its properties. Secondly, Peru is not now engaging in any such talks and does not appear disposed to do so.

As part of a Peruvian campaign to gain Latin American backing in its dispute with the U.S., Lima had the Peruvian ambassador to Argentina, Dr. Gonzalo Buyo, tell the press on Mar. 3 that "there are no top officials of the oil company in Lima for the government to talk to." Failing many efforts to communicate with the government, the oil company has indeed withdrawn its top executives. Peru also has circulated the word privately among Latin American governments that if they do not side with Lima in its dispute with Washington, Peru will withdraw from the Organization of American States. Though most Latin American diplomats feel their governments will be forced to act sympathetically toward Peru, privately many are exasperated over the ruckus Peru's military rulers are kicking up.

The latter seized the U.S. oil companies on the charge they owe Peru back taxes since the early 1920s.
