Deere also was to report test results from the discharge to Moline officials. According to the release, the facility generated wastewater containing heavy metal pollutants, including chromium, nickel, copper, lead and zinc. The federal indictment states Mr. Hill allegedly withheld those reports.

It also states Mr. Hill was responsible for notifying the city of Moline of these violations, verbally and in writing, but he allegedly failed to notify the city on 23 separate occasions between May 14, 2004, and Dec. 21, 2004. Court records indicate Mr. Hill is scheduled to appear in federal court In Rock Island on May 29.

According to the U.S. Attorney's office, Mr. Hill could face up to three years in prison for each violation and a fine of $5,000 to for each day of the violation.
