Ex-Congressman Mason Trying a Damages Case. Briefs of Suits Begun and Settled In the Various Court Rooms. The Hazelton Tripod Boiler Company mads an assignment io the County Court yesterday for the bene At of creditors. The assignee ia the secretary of the company Creorg-o VV. Griffin.

The President ia C. II. Holmes, former President of the South Side Company. No statement of the fleet and liabilities has been made, but the attorney, L. H.

Bisoee, puts the former at $65,000, and the latter at only $25,000. He also state that it ia not a failure, but simply an assignment for the purpose of closing up an unprofitable business. The company was organised some two years ago, and it waa commonly reported that Mr. Holmes was heavily interested in the company. The immediate cause of the assignment was a $1,500 judgment obtained a week ago in the United States Courts against the company and in favor of the Linden Stsel Company, of Pittsburg.

"Never since the company was organized," said Attorney Bus bee, has it paid. The members of the company have abundant means, but grew tired of throwing money into a losing business. The assets will more than double the liabilities. There are no large creditors, and most of them are merchant creditors. JoMph Barta's Death.

John Hildinger, who kicked a little child to death at Smith land, a few weeks ago, has been arrested and ia in jail at Southland, itb strona probability ot being lynched. When arrested be admitted that he was guilty, but said be was drunk, and did not know what be was doing, lie said the woman was not his wife, but that he had picked her up on his way down the river. The woman was sent for, and identified him, as did four other persons. After the identification Hildintrer asked the County Judge to issue an order tor his removal to the jail in this city. The Judge refused the request, assuring him that he would be protected from any mob violence.
