12 RECORD OF THE COURTS. Judge Tuley Decides a Point im Favor of Ex-County Treasurer Seipp. Wlfs of a Traveling Han Uakea Peculiar Charge The Boysoa Case. 'A Supreme Court Decision Bears on the Kean Case Legal Briefs. INTEREST ON COUNT? FUNDS.

Allegation are made in the bill that Seipp deposited the county funds under aeeret arrangement with Tariooa banka and received large inmi of interest whioh he declines to torn ortr to the oonnty. An aooonnting for anoh amounts and a tUeeovery la prayed. A. Penee and ex-Judge Smith argued for defendant They oontended that an aasnmp-ait or an action in debt under the official bond vu a plain and oomplete remedy.

Seipp had constitutional rixbt to a trial by jury which the constitution guaranteed. In this oaae there waa not a pretext for claiming equity jurisdiction on the ground of discovery. Tbo Treasurer is in no sense the bailee or trustee of the publio funds, bat hia obligations and hia sureties rest wholly in contract under his offioial bond. The statute does nt proride that the Treasurer shall keep a separate official deposit account with the bank of deposit. He may chooee hia ownmode of keeping funds, mud his obligations to the oouaay in this regard are reserved by the special contract embodied in kia official bond, and these are statutory.

Attorney Juild, a law partner of Mr. Walker, aaid that this bill was based under the constitution of 1S70, which provided that oonnty officials, such as treasurer, "shall receire a their only coni- penaation for services salaries to be fixed by the law (County Commissioner in this caso), and any fees or pro tits above said salary shall paid into the county treasury." Mr. Walker argnod that the county no doubt bad a remedy at law, but eould obtain better relief in a court of equity.

A decision Just made by the Supreme Court Is important in its bearing on the petitions for preference againat the estate of .8. A. Kean, banker. The case in question is the Union Rational Bank against John W. Goetx.

In the opinion the judges take the position that money can not be received as a trust fund after it has been mixed with a general mass of property. "The decision," said Attorney representing the aean assumes, "sustains my position in regard to all these petitions against the estate. The petitioners must pro-rate." xeateraay attorney representing Esther Pugh, treasurer of the Women's Christian Temperance Union, dismissed their appeal from Judge Scales' decision against petition for preferenoe on a 3.000 claim.
